A bill to be entitled
2An act relating to vehicle crashes involving death;
3amending s. 316.027, F.S.; requiring that a defendant
4arrested for leaving the scene of a crash involving death
5must be held in custody until brought before a judge for
6admittance to bail; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (b) of subsection (1) of section
11316.027, Florida Statutes, is amended to read:
12     316.027  Crash involving death or personal injuries.--
13     (1)
14     (b)  The driver of any vehicle involved in a crash
15occurring on public or private property that results in the
16death of any person must immediately stop the vehicle at the
17scene of the crash, or as close thereto as possible, and must
18remain at the scene of the crash until he or she has fulfilled
19the requirements of s. 316.062. A defendant arrested for a
20violation of this paragraph shall be held in custody until
21brought before the court for admittance to bail in accordance
22with chapter 903. Any person who willfully violates this
23paragraph commits a felony of the first degree, punishable as
24provided in s. 775.082, s. 775.083, or s. 775.084. Any person
25who willfully commits such a violation violates this paragraph
26while driving under the influence as set forth in s. 316.193(1)
27shall be sentenced to a mandatory minimum term of imprisonment
28of 2 years.
29     Section 2.  This act shall take effect July 1, 2010.
