A bill to be entitled
2An act relating to public records; creating s. 341.3026,
3F.S.; providing an exemption from public records
4requirements for personal identifying information held by
5a public transit provider for the purpose of facilitating
6the prepayment of transit fares or the acquisition of a
7prepaid transit fare card or similar device; providing for
8future review and repeal of the exemption; providing a
9statement of public necessity; providing an effective
10date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 341.3026, Florida Statutes, is created
15to read:
16     341.3026  Public records exemption.-
17     (1)  Personal identifying information held by a public
18transit provider, as defined in s. 341.031, for the purpose of
19facilitating the prepayment of transit fares or the acquisition
20of a prepaid transit fare card or similar device is exempt from
21s. 119.07(1) and s. 24(a), Art. I of the State Constitution.
22     (2)  This section is subject to the Open Government Sunset
23Review Act in accordance with s. 119.15 and shall stand repealed
24on October 2, 2015, unless reviewed and saved from repeal
25through reenactment by the Legislature.
26     Section 2.  The Legislature finds that it is a public
27necessity to exempt from public records requirements personal
28identifying information held by a public transit provider for
29the purpose of facilitating the prepayment of transit fares or
30the acquisition of a prepaid transit fare card or similar
31device. The exemption puts individuals who choose a prepayment
32option for transit fares on an equal footing with users of
33public transit who pay their fares in cash. Allowing individuals
34to use a prepaid transit fare card is a more efficient and
35effective system for collecting transit fares, and not only
36saves individuals time in accessing the transit system in
37comparison with individuals who pay cash, but also costs
38significantly less to administer. The effective and efficient
39administration of the prepayment option for public transit
40programs would be hindered without the exemption because
41individuals would be less inclined to use this payment method if
42their personal information were made available to the public.
43     Section 3.  This act shall take effect July 1, 2010.
