| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 341.3026, Florida Statutes, is created |
| 15 | to read: |
| 16 | 341.3026 Public records exemption.- |
| 17 | (1) Personal identifying information held by a public |
| 18 | transit provider, as defined in s. 341.031, for the purpose of |
| 19 | facilitating the prepayment of transit fares or the acquisition |
| 20 | of a prepaid transit fare card or similar device is exempt from |
| 21 | s. 119.07(1) and s. 24(a), Art. I of the State Constitution. |
| 22 | (2) This section is subject to the Open Government Sunset |
| 23 | Review Act in accordance with s. 119.15 and shall stand repealed |
| 24 | on October 2, 2015, unless reviewed and saved from repeal |
| 25 | through reenactment by the Legislature. |
| 26 | Section 2. The Legislature finds that it is a public |
| 27 | necessity to exempt from public records requirements personal |
| 28 | identifying information held by a public transit provider for |
| 29 | the purpose of facilitating the prepayment of transit fares or |
| 30 | the acquisition of a prepaid transit fare card or similar |
| 31 | device. The exemption puts individuals who choose a prepayment |
| 32 | option for transit fares on an equal footing with users of |
| 33 | public transit who pay their fares in cash. Allowing individuals |
| 34 | to use a prepaid transit fare card is a more efficient and |
| 35 | effective system for collecting transit fares, and not only |
| 36 | saves individuals time in accessing the transit system in |
| 37 | comparison with individuals who pay cash, but also costs |
| 38 | significantly less to administer. The effective and efficient |
| 39 | administration of the prepayment option for public transit |
| 40 | programs would be hindered without the exemption because |
| 41 | individuals would be less inclined to use this payment method if |
| 42 | their personal information were made available to the public. |
| 43 | Section 3. This act shall take effect July 1, 2010. |
