A bill to be entitled
2An act relating to criminal conduct; amending s. 827.03,
3F.S.; defining the term "mental injury" with respect to
4the offenses of child abuse and aggravated child abuse;
5requiring an expert witness who testifies regarding a
6child's mental injury to have certain credentials;
7providing affirmative defenses to the offenses of child
8abuse, aggravated child abuse, and neglect; amending ss.
9775.084, 775.0877, 782.07, 921.0022, and 948.062, F.S.;
10conforming cross-references; amending s. 960.03, F.S.;
11redefining the term "crime" for purposes of crime victim
12compensation to include additional forms of injury;
13providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Section 827.03, Florida Statutes, is amended to
18read:
19     827.03  Abuse, aggravated abuse, and neglect of a child;
20penalties.-
21     (1)  DEFINITIONS.-For purposes of this section:
22     (a)  "Aggravated child abuse" occurs when a person:
23     1.  Commits aggravated battery on a child;
24     2.  Willfully tortures, maliciously punishes, or willfully
25and unlawfully cages a child; or
26     3.  Knowingly or willfully abuses a child and in so doing
27causes great bodily harm, permanent disability, or permanent
28disfigurement to the child.
29     (b)  "Child abuse" means:
30     1.(a)  Intentional infliction of physical or mental injury
31upon a child;
32     2.(b)  An intentional act that could reasonably be expected
33to result in physical or mental injury to a child; or
34     3.(c)  Active encouragement of any person to commit an act
35that results or could reasonably be expected to result in
36physical or mental injury to a child.

38A person who knowingly or willfully abuses a child without
39causing great bodily harm, permanent disability, or permanent
40disfigurement to the child commits a felony of the third degree,
41punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
42     (2)  "Aggravated child abuse" occurs when a person:
43     (a)  Commits aggravated battery on a child;
44     (b)  Willfully tortures, maliciously punishes, or willfully
45and unlawfully cages a child; or
46     (c)  Knowingly or willfully abuses a child and in so doing
47causes great bodily harm, permanent disability, or permanent
48disfigurement to the child.

50A person who commits aggravated child abuse commits a felony of
51the first degree, punishable as provided in s. 775.082, s.
52775.083, or s. 775.084.
53     (c)  "Maliciously" means wrongfully, intentionally, and
54without legal justification or excuse. Maliciousness may be
55established by circumstances from which one could conclude that
56a reasonable parent would not have engaged in the damaging acts
57toward the child for any valid reason and that the primary
58purpose of the acts was to cause the victim unjustifiable pain
59or injury.
60     (d)  "Mental injury" means injury to the intellectual or
61psychological capacity of a child as evidenced by a discernible
62and substantial impairment in the ability of the child to
63function within the normal range of performance and behavior as
64supported by expert testimony. A person may not give expert
65testimony regarding mental injury unless that person is a
66physician licensed under chapter 458 or chapter 459, board-
67certified in psychiatry, or a psychologist licensed under
68chapter 490, and, during the 3 years immediately preceding the
69date of the alleged injury, has devoted professional time to the
70active clinical practice of, or consulting with respect to, a
71specialty that includes the evaluation, diagnosis, or treatment
72of the condition that is the subject of the offense. The expert
73testimony requirements apply only to criminal court cases, not
74to family court or dependency court cases.
75     (e)(3)(a)  "Neglect of a child" means:
76     1.  A caregiver's failure or omission to provide a child
77with the care, supervision, and services necessary to maintain
78the child's physical and mental health, including, but not
79limited to, food, nutrition, clothing, shelter, supervision,
80medicine, and medical services that a prudent person would
81consider essential for the well-being of the child; or
82     2.  A caregiver's failure to make a reasonable effort to
83protect a child from abuse, neglect, or exploitation by another
84person.

86Except as otherwise provided in this section, neglect of a child
87may be based on repeated conduct or on a single incident or
88omission that results in, or could reasonably be expected to
89result in, serious physical or mental injury, or a substantial
90risk of death, to a child.
91     (2)  OFFENSES.-
92     (a)  A person who commits aggravated child abuse commits a
93felony of the first degree, punishable as provided in s.
94775.082, s. 775.083, or s. 775.084.
95     (b)  A person who willfully or by culpable negligence
96neglects a child and in so doing causes great bodily harm,
97permanent disability, or permanent disfigurement to the child
98commits a felony of the second degree, punishable as provided in
99s. 775.082, s. 775.083, or s. 775.084.
100     (c)  A person who knowingly or willfully abuses a child
101without causing great bodily harm, permanent disability, or
102permanent disfigurement to the child commits a felony of the
103third degree, punishable as provided in s. 775.082, s. 775.083,
104or s. 775.084.
105     (d)(c)  A person who willfully or by culpable negligence
106neglects a child without causing great bodily harm, permanent
107disability, or permanent disfigurement to the child commits a
108felony of the third degree, punishable as provided in s.
109775.082, s. 775.083, or s. 775.084.
110     (3)  AFFIRMATIVE DEFENSES.-
111     (a)  If the offense is based solely on oral statements of
112the defendant, it is an affirmative defense to a prosecution
113under this section that the conduct giving rise to the offense
114was solely speech protected by the First Amendment to the United
115States Constitution. This affirmative defense does not apply to
116speech that was directed to inciting or producing imminent
117lawless action and that was likely to incite or produce such
118action.
119     (b)  If the offense is based solely on a claim of mental
120injury because of a caregiver's failure to make a reasonable
121effort to protect a child from an abuser other than the
122defendant, it is an affirmative defense to a prosecution under
123this section that the defendant was a victim of an act of
124domestic violence or had reasonable cause to believe that he or
125she was about to become a victim of an act of domestic violence
126as defined in s. 741.28, and the defendant had reasonable cause
127to believe that the action or failure to act was necessary in
128order for the defendant to escape from, or protect himself or
129herself from, the domestic violence or to preserve the minor or
130incompetent person from exposure to domestic violence. However,
131this affirmative defense is not available to any person in
132relation to instances of child abuse arising after the defense
133has been previously asserted with respect to the same abuser.
134     (4)  For purposes of this section, "maliciously" means
135wrongfully, intentionally, and without legal justification or
136excuse. Maliciousness may be established by circumstances from
137which one could conclude that a reasonable parent would not have
138engaged in the damaging acts toward the child for any valid
139reason and that the primary purpose of the acts was to cause the
140victim unjustifiable pain or injury.
141     Section 2.  Paragraph (d) of subsection (1) of section
142775.084, Florida Statutes, is amended to read:
143     775.084  Violent career criminals; habitual felony
144offenders and habitual violent felony offenders; three-time
145violent felony offenders; definitions; procedure; enhanced
146penalties or mandatory minimum prison terms.-
147     (1)  As used in this act:
148     (d)  "Violent career criminal" means a defendant for whom
149the court must impose imprisonment pursuant to paragraph (4)(d),
150if it finds that:
151     1.  The defendant has previously been convicted as an adult
152three or more times for an offense in this state or other
153qualified offense that is:
154     a.  Any forcible felony, as described in s. 776.08;
155     b.  Aggravated stalking, as described in s. 784.048(3) and
156(4);
157     c.  Aggravated child abuse, as described in s. 827.03(2);
158     d.  Aggravated abuse of an elderly person or disabled
159adult, as described in s. 825.102(2);
160     e.  Lewd or lascivious battery, lewd or lascivious
161molestation, lewd or lascivious conduct, or lewd or lascivious
162exhibition, as described in s. 800.04 or s. 847.0135(5);
163     f.  Escape, as described in s. 944.40; or
164     g.  A felony violation of chapter 790 involving the use or
165possession of a firearm.
166     2.  The defendant has been incarcerated in a state prison
167or a federal prison.
168     3.  The primary felony offense for which the defendant is
169to be sentenced is a felony enumerated in subparagraph 1. and
170was committed on or after October 1, 1995, and:
171     a.  While the defendant was serving a prison sentence or
172other sentence, or court-ordered or lawfully imposed supervision
173that is imposed as a result of a prior conviction for an
174enumerated felony; or
175     b.  Within 5 years after the conviction of the last prior
176enumerated felony, or within 5 years after the defendant's
177release from a prison sentence, probation, community control,
178control release, conditional release, parole, or court-ordered
179or lawfully imposed supervision or other sentence that is
180imposed as a result of a prior conviction for an enumerated
181felony, whichever is later.
182     4.  The defendant has not received a pardon for any felony
183or other qualified offense that is necessary for the operation
184of this paragraph.
185     5.  A conviction of a felony or other qualified offense
186necessary to the operation of this paragraph has not been set
187aside in any postconviction proceeding.
188     Section 3.  Subsection (1) of section 775.0877, Florida
189Statutes, is amended to read:
190     775.0877  Criminal transmission of HIV; procedures;
191penalties.-
192     (1)  In any case in which a person has been convicted of or
193has pled nolo contendere or guilty to, regardless of whether
194adjudication is withheld, any of the following offenses, or the
195attempt thereof, which offense or attempted offense involves the
196transmission of body fluids from one person to another:
197     (a)  Section 794.011, relating to sexual battery,
198     (b)  Section 826.04, relating to incest,
199     (c)  Section 800.04(1), (2), and (3), relating to lewd,
200lascivious, or indecent assault or act upon any person less than
20116 years of age,
202     (d)  Sections 784.011, 784.07(2)(a), and 784.08(2)(d),
203relating to assault,
204     (e)  Sections 784.021, 784.07(2)(c), and 784.08(2)(b),
205relating to aggravated assault,
206     (f)  Sections 784.03, 784.07(2)(b), and 784.08(2)(c),
207relating to battery,
208     (g)  Sections 784.045, 784.07(2)(d), and 784.08(2)(a),
209relating to aggravated battery,
210     (h)  Section 827.03(1), relating to child abuse,
211     (i)  Section 827.03(2), relating to aggravated child abuse,
212     (j)  Section 825.102(1), relating to abuse of an elderly
213person or disabled adult,
214     (k)  Section 825.102(2), relating to aggravated abuse of an
215elderly person or disabled adult,
216     (l)  Section 827.071, relating to sexual performance by
217person less than 18 years of age,
218     (m)  Sections 796.03, 796.07, and 796.08, relating to
219prostitution, or
220     (n)  Section 381.0041(11)(b), relating to donation of
221blood, plasma, organs, skin, or other human tissue,

223the court shall order the offender to undergo HIV testing, to be
224performed under the direction of the Department of Health in
225accordance with s. 381.004, unless the offender has undergone
226HIV testing voluntarily or pursuant to procedures established in
227s. 381.004(3)(h)6. or s. 951.27, or any other applicable law or
228rule providing for HIV testing of criminal offenders or inmates,
229subsequent to her or his arrest for an offense enumerated in
230paragraphs (a)-(n) for which she or he was convicted or to which
231she or he pled nolo contendere or guilty. The results of an HIV
232test performed on an offender pursuant to this subsection are
233not admissible in any criminal proceeding arising out of the
234alleged offense.
235     Section 4.  Subsection (3) of section 782.07, Florida
236Statutes, is amended to read:
237     782.07  Manslaughter; aggravated manslaughter of an elderly
238person or disabled adult; aggravated manslaughter of a child;
239aggravated manslaughter of an officer, a firefighter, an
240emergency medical technician, or a paramedic.-
241     (3)  A person who causes the death of any person under the
242age of 18 by culpable negligence under s. 827.03(1)(e)(3)
243commits aggravated manslaughter of a child, a felony of the
244first degree, punishable as provided in s. 775.082, s. 775.083,
245or s. 775.084.
246     Section 5.  Paragraphs (f), (g), and (i) of subsection (3)
247of section 921.0022, Florida Statutes, are amended to read:

476     (1)  The department shall review the circumstances related
477to an offender placed on probation or community control who has
478been arrested while on supervision for the following offenses:
479     (a)  Any murder as provided in s. 782.04;
480     (b)  Any sexual battery as provided in s. 794.011 or s.
481794.023;
482     (c)  Any sexual performance by a child as provided in s.
483827.071;
484     (d)  Any kidnapping, false imprisonment, or luring of a
485child as provided in s. 787.01, s. 787.02, or s. 787.025;
486     (e)  Any lewd and lascivious battery or lewd and lascivious
487molestation as provided in s. 800.04(4) or (5);
488     (f)  Any aggravated child abuse as provided in s.
489827.03(2);
490     (g)  Any robbery with a firearm or other deadly weapon,
491home invasion robbery, or carjacking as provided in s.
492812.13(2)(a), s. 812.135, or s. 812.133;
493     (h)  Any aggravated stalking as provided in s. 784.048(3),

503     Section 7.  Paragraph (a) of subsection (3) of section
504960.03, Florida Statutes, is amended to read:
505     960.03  Definitions; ss. 960.01-960.28.-As used in ss.
506960.01-960.28, unless the context otherwise requires, the term:
507     (3)  "Crime" means:
508     (a)  A felony or misdemeanor offense committed by either an
509adult or a juvenile which results in:
510     1.  Physical injury or death; or
511     2.  Psychiatric or psychological injury to a person younger
512than 18 years of age who was not physically injured by the
513criminal act.

515The term also includes any such criminal act which is committed
516within this state but which falls exclusively within federal
517jurisdiction.
518     Section 8.  This act shall take effect July 1, 2010.
