A bill to be entitled
2An act relating to collective bargaining; amending s.
3447.203, F.S.; redefining the term "legislative body" for
4purposes of collective bargaining impasses with respect to
5the employees of certain county constitutional officers;
6requiring the board of county commissioners to provide
7supplemental funds to such county constitutional officers
8under certain circumstances; providing that the resolution
9of certain impasses is binding on all parties; specifying
10the parties required to approve certain collective
11bargaining agreements; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15     Section 1.  Subsection (10) of section 447.203, Florida
16Statutes, is amended to read:
17     447.203  Definitions.-As used in this part:
18     (10)  "Legislative body" means the State Legislature, the
19board of county commissioners, the district school board, the
20governing body of a municipality, or the governing body of an
21instrumentality or unit of government having authority to
22appropriate funds and establish policy governing the terms and
23conditions of employment and which, as the case may be, is the
24appropriate legislative body for the bargaining unit. For
25purposes of s. 447.403:,
26     (a)  The Board of Governors of the State University System,
27or the board's designee, is shall be deemed to be the
28legislative body for with respect to all employees of each
29constituent state university.
30     (b)  For purposes of s. 447.403 The board of trustees of a
31community college is shall be deemed to be the legislative body
32for with respect to all employees of the community college.
33     (c)  The sheriff, tax collector, property appraiser,
34supervisor of elections, and clerk of the circuit court, as
35county constitutional officers under s. 1(d), Art. VIII of the
36State Constitution, are each deemed to be the legislative body
37for his or her respective employees, except:
38     1.  If an impasse is declared pursuant to s. 447.403 and
39the disputed impasse issues relate to wages or other economic
40benefits, the board of county commissioners is deemed to be the
41legislative body. However, if the resolution by the board of
42county commissioners of the disputed impasse issues provides for
43an increase in wages or other economic benefits beyond the
44county constitutional officer's final offer at impasse, the
45board of county commissioners shall provide supplemental funds
46to the county constitutional officer that are sufficient to pay
47the increased wages or other economic benefits beyond the county
48constitutional officer's final offer at impasse. Such a
49resolution of the impasse is binding on all parties.
50Notwithstanding this subparagraph, the county constitutional
51officer and his or her employees who are members of the
52bargaining unit shall be the parties required to approve the
53collective bargaining agreement pursuant to s. 447.309.
54     2.  If a sheriff contracts with another governmental body
55to function as the public employer for firefighters as defined
56in s. 633.30, emergency medical technicians as defined in s.
57401.23, or paramedics as defined in s. 401.23, the contracting
58governmental body is deemed to be the legislative body for those
59employees.
60     Section 2.  This act shall take effect July 1, 2010.
