A bill to be entitled
2An act relating to illegal immigration; creating s.
3111.076, F.S.; prohibiting restrictions on the reporting
4of certain immigration status information by public
5employees; creating ss. 125.582 and 166.04935, F.S.;
6prohibiting certain local government restrictions
7concerning communication or cooperation with federal
8officials concerning immigration law enforcement;
9providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Section 111.076, Florida Statutes, is created
14to read:
15     111.076  Reporting of immigration status information.-
16Notwithstanding any other provision of law, an agency, as
17defined in s. 20.03, may not prohibit or in any way restrict a
18public employee from doing any of the following with respect to
19information regarding the immigration status of any individual:
20     (1)  Sending such information to, or requesting or
21receiving such information from, the United States Department of
22Homeland Security;
23     (2)  Maintaining such information; or
24     (3)  Exchanging such information with any other federal,
25state, or local governmental entity.
26     Section 2.  Section 125.582, Florida Statutes, is created
27to read:
28     125.582  Communicating or cooperating with federal
29officials concerning immigration.-
30     (1)  A county government, whether acting through its
31governing body or by an initiative, referendum, or any other
32process, may not enact any ordinance or policy that limits or
33prohibits a law enforcement officer, local official, or local
34government employee from communicating or cooperating with
35federal officials with regard to the immigration status of any
36person within this state.
37     (2)  Notwithstanding any other provision of law, a county
38governmental entity or official may not prohibit or in any way
39restrict any governmental entity or government official from
40sending to, or receiving from, the United States Department of
41Homeland Security information regarding the citizenship or
42immigration status of any individual.
43     Section 3.  Section 166.04935, Florida Statutes, is created
44to read:
45     166.04935  Communicating or cooperating with federal
46officials concerning immigration.-
47     (1)  A municipal government, whether acting through its
48governing body or by an initiative, referendum, or any other
49process, may not enact any ordinance or policy that limits or
50prohibits a law enforcement officer, local official, or local
51government employee from communicating or cooperating with
52federal officials with regard to the immigration status of any
53person within this state.
54     (2)  Notwithstanding any other provision of law, a
55municipal governmental entity or official may not prohibit or in
56any way restrict any governmental entity or government official
57from sending to, or receiving from, the United States Department
58of Homeland Security information regarding the citizenship or
59immigration status of any individual.
60     Section 4.  This act shall take effect July 1, 2010.
