    2         An act relating to virtual schools; amending s.
    3         1002.33, F.S.; providing that a virtual school
    4         operated by an approved provider under s. 1002.45,
    5         F.S., may be a charter school for purposes of s.
    6         1002.33, F.S.; providing that the virtual school is
    7         not subject to certain provisions pertaining to
    8         facilities or student transportation; providing an
    9         effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (1) of section 1002.33, Florida
   14  Statutes, is amended to read:
   15         1002.33 Charter schools.—
   16         (1) AUTHORIZATION.—Charter schools shall be part of the
   17  state’s program of public education. All charter schools in
   18  Florida are public schools. A charter school may be formed by
   19  creating a new school or converting an existing public school to
   20  charter status. A virtual school operated by a provider that is
   21  approved by the Department of Education under s. 1002.45 may be
   22  a charter school for purposes of this section. However, the
   23  virtual school is not subject to or governed by the provisions
   24  in this section which pertain to facilities or student
   25  transportation. A public school may not use the term charter in
   26  its name unless it has been approved under this section.
   27         Section 2. This act shall take effect July 1, 2010.
