A bill to be entitled
2An act relating to the supplemental corporate fee;
3amending s. 607.0122, F.S.; specifying that a
4reinstatement application fee includes a certain late
5charge; amending s. 607.193, F.S.; deleting an exception
6for liability for a late charge; amending s. 607.1422,
7F.S.; requiring inclusion of a reinstatement application
8fee under fees owed by a corporation seeking reinstatement
9after administrative dissolution; providing an effective
10date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Subsection (13) of section 607.0122, Florida
15Statutes, is amended to read:
16     607.0122  Fees for filing documents and issuing
17certificates.-The Department of State shall collect the
18following fees when the documents described in this section are
19delivered to the department for filing:
20     (13)  Application for reinstatement following
21administrative dissolution: $600. This fee includes the late
22charge imposed under s. 607.193(2)(b).
23     Section 2.  Paragraph (b) of subsection (2) of section
24607.193, Florida Statutes, is amended to read:
25     607.193  Supplemental corporate fee.-
26     (2)
27     (b)  In addition to the fees levied under ss. 607.0122,
28608.452, and 620.1109 and the supplemental corporate fee, a late
29charge of $400 shall be imposed if the supplemental corporate
30fee is remitted after May 1 except in circumstances in which a
31business entity did not receive the uniform business report
32prescribed by the department.
33     Section 3.  Subsection (1) of section 607.1422, Florida
34Statutes, is amended to read:
35     607.1422  Reinstatement following administrative
36dissolution.-
37     (1)  A corporation administratively dissolved under s.
38607.1421 may apply to the Department of State for reinstatement
39at any time after the effective date of dissolution. The
40corporation must submit a reinstatement form prescribed and
41furnished by the Department of State or a current uniform
42business report signed by the registered agent and an officer or
43director and all fees then owed by the corporation including the
44reinstatement application fee required under s. 607.0122(13),
45computed at the rate provided by law at the time the corporation
46applies for reinstatement.
47     Section 4.  This act shall take effect July 1, 2010.
