A bill to be entitled
2An act relating to notification of school personnel;
3amending s. 985.04, F.S.; requiring that specified school
4personnel be notified when a child of any age is formally
5charged by a state attorney with a felony or a delinquent
6act that would be a felony if committed by an adult;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (b) of subsection (4) of section
12985.04, Florida Statutes, is amended to read:
13     985.04  Oaths; records; confidential information.-
14     (4)
15     (b)  Notwithstanding paragraph (a) or any other provision
16of this section, when a child of any age is formally charged by
17a state attorney with a felony or a delinquent act that would be
18a felony if committed by an adult, the state attorney shall
19notify the superintendent of the child's school that the child
20has been charged with such felony or delinquent act. The
21information obtained by the superintendent of schools under this
22section must be released within 48 hours after receipt to
23appropriate school personnel, including the principal of the
24school of the child and the director of transportation. The
25principal must immediately notify the child's immediate
26classroom teachers and paraprofessionals. The director of
27transportation shall immediately notify the child's assigned bus
28driver. Upon notification, the principal is authorized to begin
29disciplinary actions under s. 1006.09(1)-(4).
30     Section 2.  This act shall take effect July 1, 2010.
