A bill to be entitled
2An act relating to substantial assistance; creating s.
3921.186, F.S.; permitting the state attorney to request
4the sentencing court to reduce or suspend the sentence of
5a person who has been convicted of violating any felony
6offense and who provides substantial assistance in the
7identification, arrest, or conviction of any accomplice,
8accessory, coconspirator, or principal of the person or
9other felon; providing that the arresting agency shall be
10given an opportunity to be heard in aggravation or
11mitigation in reference to any such motion; providing that
12the motion may be filed and heard in camera for good cause
13shown; providing that a judge may reduce or suspend the
14sentence if the judge finds that the defendant rendered
15substantial assistance; providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:

19     Section 1.  Section 921.186, Florida Statutes, is created
20to read:
21     921.186  Substantial assistance.-Notwithstanding any other
22law, the state attorney may move the sentencing court to reduce
23or suspend the sentence of any person who is convicted of
24violating any felony offense and who provides substantial
25assistance in the identification, arrest, or conviction of any
26of that person's accomplices, accessories, coconspirators, or
27principals or of any other person engaged in criminal activity
28that would constitute a felony. The arresting agency shall be
29given an opportunity to be heard in aggravation or mitigation in
30reference to any such motion. Upon good cause shown, the motion
31may be filed and heard in camera. The judge hearing the motion
32may reduce or suspend the sentence if the judge finds that the
33defendant rendered such substantial assistance.
34     Section 2.  This act shall take effect July 1, 2010.
