A bill to be entitled
2An act relating to human trafficking; creating s.
3480.0535, F.S.; specifying documents that must be
4possessed by each person providing or offering to provide
5massage services; requiring presentation of such documents
6upon request of a law enforcement officer; requiring
7operators of massage establishments to maintain valid work
8authorization documents on the premises for each employee
9who is not a United States citizen; requiring presentation
10of such documents upon request of a law enforcement
11officer; prohibiting the use of a massage establishment
12license for the purpose of lewdness, assignation, or
13prostitution; providing criminal penalties; providing an
14effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Section 480.0535, Florida Statutes, is created
19to read:
20     480.0535  Documents required while offering or providing
21massage services.-
22     (1)  To provide law enforcement the means to more
23effectively identify, investigate, and arrest persons engaging
24in human trafficking as defined in s. 787.06 or prostitution as
25proscribed by chapter 796 by the fraudulent or valid use of a
26license to practice massage therapy or operate a massage
27establishment:
28     (a)  Each person providing or offering to provide massage
29services must have in his or her possession, and it is unlawful
30to provide or offer to provide massage services without, a
31wallet-size identification license card or wall license card
32issued by the Department of Health pursuant to s. 456.013, plus
33one of the following documents specifically issued to such
34person:
35     1.  A current driver's license or identification card
36issued by a state.
37     2.  A valid passport issued by the United States of
38America.
39     3.  A valid I-551 permanent resident card.
40     4.  A valid employment authorization document.
41     (b)  Upon request by a law enforcement officer, each person
42providing or offering to provide massage services must present
43the wallet-size identification license card or wall license card
44issued by the Department of Health pursuant to s. 456.013, plus
45one of the additional documents specified in paragraph (a).
46     (2)(a)  Any person, firm, or corporation operating a
47massage establishment pursuant to s. 480.043 shall maintain, and
48it is unlawful to operate a massage establishment without, a
49valid work authorization document on the premises for each
50employee who is not a United States citizen. Valid work
51authorization documents for an employee who is not a United
52States citizen include:
53     1.  A valid I-551 permanent resident card.
54     2.  A valid employment authorization document.
55     (b)  Upon request by a law enforcement officer, any person,
56firm, or corporation operating a massage establishment must
57present one of the documents specified in paragraph (a) for each
58employee who is not a United States citizen.
59     (3)  It is unlawful to knowingly use a massage
60establishment license issued under s. 480.043 for the purpose of
61lewdness, assignation, or prostitution at any massage
62establishment location or structure, or any part thereof,
63including any trailer or other conveyance.
64     (4)  A person who violates any provision of this section
65commits:
66     (a)  A misdemeanor of the second degree for a first
67violation, punishable as provided in s. 775.082 or s. 775.083.
68     (b)  A misdemeanor of the first degree for a second
69violation, punishable as provided in s. 775.082 or s. 775.083.
70     (c)  A felony of the third degree for a third or subsequent
71violation, punishable as provided in s. 775.082, s. 775.083, or
72s. 775.084.
73     Section 2.  This act shall take effect July 1, 2010.
