A bill to be entitled
2An act relating to correctional probation officers;
3amending s. 112.181, F.S.; revising the definition of the
4term "emergency rescue or public safety worker" to include
5correctional probation officers in provisions relating to
6certain communicable diseases suffered in the line of
7duty; amending s. 112.19, F.S.; revising provisions
8relating to death benefits to include correctional
9probation officers; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Paragraph (b) of subsection (1) of section
14112.181, Florida Statutes, is amended to read:
15     112.181  Firefighters, paramedics, emergency medical
16technicians, law enforcement officers, correctional probation
17officer, correctional officers; special provisions relative to
18certain communicable diseases.-
19     (1)  DEFINITIONS.-As used in this section, the term:
20     (b)  "Emergency rescue or public safety worker" means any
21person employed full time by the state or any political
22subdivision of the state as a firefighter, paramedic, emergency
23medical technician, law enforcement officer, correctional
24probation officer, or correctional officer who, in the course of
25employment, runs a high risk of occupational exposure to
26hepatitis, meningococcal meningitis, or tuberculosis and who is
27not employed elsewhere in a similar capacity. However, the term
28"emergency rescue or public safety worker" does not include any
29person employed by a public hospital licensed under chapter 395
30or any person employed by a subsidiary thereof.
31     Section 2.  Paragraph (g) of subsection (2) of section
32112.19, Florida Statutes, is amended to read:
33     112.19  Law enforcement, correctional, and correctional
34probation officers; death benefits.-
35     (2)
36     (g)  Any political subdivision of the state that employs a
37full-time law enforcement officer as defined in s. 943.10(1), or
38a full-time correctional officer as defined in s. 943.10(2), or
39a full-time correctional probation officer as defined in s.
40943.10(3) who is killed in the line of duty on or after July 1,
411993, as a result of an act of violence inflicted by another
42person while the officer is engaged in the performance of law
43enforcement duties or as a result of an assault against the
44officer under riot conditions shall pay the entire premium of
45the political subdivision's health insurance plan for the
46employee's surviving spouse until remarried, and for each
47dependent child of the employee until the child reaches the age
48of majority or until the end of the calendar year in which the
49child reaches the age of 25 if:
50     1.  At the time of the employee's death, the child is
51dependent upon the employee for support; and
52     2.  The surviving child continues to be dependent for
53support, or the surviving child is a full-time or part-time
54student and is dependent for support.
55     Section 3.  This act shall take effect July 1, 2010.
