| 6 | designers, and registered landscape architects are liable |
| 7 | must cause personal injury or damage to property other |
| 8 | than the property that is the subject of the professional |
| 9 | services; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Section 471.046, Florida Statutes, is created |
| 14 | to read: |
| 15 | 471.046 Limitation of causes of action.-Notwithstanding |
| 16 | any other law, a person does not have a cause of action against |
| 17 | a licensee under this chapter for the recovery of economic |
| 18 | damages that result from malpractice or negligence in the |
| 19 | performance of professional services if the malpractice or |
| 20 | negligence does not cause personal injury or damage to property |
| 21 | other than the property that is the subject of the professional |
| 22 | services and the licensee performs the professional services |
| 23 | pursuant to a contract between the licensee or his or her |
| 24 | employer and either of the following persons: |
| 25 | (1) The person claiming economic damages; or |
| 26 | (2) A consultant, subconsultant, or sub-subconsultant to a |
| 27 | person or entity having a contract with the person claiming |
| 28 | economic damages to provide the professional services at issue. |
| 29 | Section 2. Section 472.0367, Florida Statutes, is created |
| 30 | to read: |
| 31 | 472.0367 Limitation of causes of action.-Notwithstanding |
| 32 | any other law, a person does not have a cause of action against |
| 33 | a licensee under this chapter for the recovery of economic |
| 34 | damages that result from malpractice or negligence in the |

| 63 | 481.333 Limitation of causes of action.-Notwithstanding |
| 64 | any other law, a person does not have a cause of action against |
| 65 | a licensee under this part for the recovery of economic damages |
| 66 | that result from malpractice or negligence in the performance of |
| 67 | professional services if the malpractice or negligence does not |
| 68 | cause personal injury or damage to property other than the |
| 69 | property that is the subject of the professional services and |
| 70 | the licensee performs the professional services pursuant to a |
| 71 | contract between the licensee or his or her employer and either |
| 72 | of the following persons: |
| 73 | (1) The person claiming economic damages; or |
| 74 | (2) A consultant, subconsultant, or sub-subconsultant to a |
| 75 | person or entity having a contract with the person claiming |
| 76 | economic damages to provide the professional services at issue. |
| 77 | Section 5. This act shall take effect upon becoming a law. |
