| 1 | A bill to be entitled |
| 2 | An act relating to compulsory health insurance coverage; |
| 3 | providing a declaration of state public policy protecting |
| 4 | persons from government compulsion to purchase health |
| 5 | insurance coverage; providing exceptions; providing |
| 6 | construction; authorizing the Attorney General to initiate |
| 7 | and advocate such public policy in federal or state court |
| 8 | or administrative forum on behalf of certain persons under |
| 9 | certain circumstances; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. (1) Consistent with the constitutional |
| 14 | liberties of residents of this state, it is hereby declared to |
| 15 | be the public policy of this state that no person may be |
| 16 | compelled by federal, state, or local government to purchase |
| 17 | health insurance or health services, except: |
| 18 | (a) As a condition of: |
| 19 | 1. Public employment; |
| 20 | 2. Voluntary participation in a state or local benefit; |
| 21 | 3. Operating a dangerous instrumentality; or |
| 22 | 4. Undertaking an occupation having a risk of occupational |
| 23 | injury or illness; or |
| 24 | (b) In case of an actual emergency declared by the |
| 25 | Governor when the public health is immediately endangered. |
| 26 | (2) This section may not be construed to prohibit |
| 27 | collection of debts lawfully and consensually incurred for |
| 28 | health insurance or health services. |
| 29 | Section 2. The Attorney General is hereby specifically |
| 30 | authorized and shall have standing to initiate and otherwise |
| 31 | advocate such public policy in any state or federal court or |
| 32 | administrative forum on behalf of one or more persons within the |
| 33 | state whose constitutional rights may be subject to infringement |
| 34 | by an act of the United States Congress with respect to health |
| 35 | insurance coverage or subject to the implementation of a federal |
| 36 | legislative program relating to or impacting the rights or |
| 37 | interests of persons with respect to health insurance coverage. |
| 38 | Section 3. This act shall take effect upon becoming a law. |
