A bill to be entitled
2An act relating to bingo; amending s. 849.0931, F.S.;
3providing a definition of instant bingo dispensers;
4authorizing the dispensing of instant bingo tickets by
5instant bingo ticket dispensers; providing an effective
6date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraphs (g) through (j) of subsection (1) of
11section 849.0931, Florida Statutes, are redesignated as
12paragraphs (h) through (k), respectively, paragraph (g) is added
13to that subsection, and paragraph (i) is added to subsection
14(13) of that section, to read:
15     849.0931  Bingo authorized; conditions for conduct;
16permitted uses of proceeds; limitations.-
17     (1)  As used in this section:
18     (g)  "Instant bingo ticket dispenser" means a mechanical or
19electronic device that dispenses an instant bingo ticket as the
20sole item of value dispensed and that has the following
21characteristics:
22     1.  Is activated upon the insertion of United States
23currency.
24     2.  Performs no gaming functions.
25     3.  Requires a winning ticket to be paid by the bingo game
26operator.
27     4.  Is capable of recording each ticket dispensed, the
28number of coins or amount of currency received for each ticket,
29and totals of each for all tickets dispensed.
30     5.  Does not contain a video display monitor visible to the
31customer or generate noise.
32     6.  Is incapable of determining whether a dispensed bingo
33ticket is a winning or losing ticket.
34     7.  Is incapable of simulating or displaying an interactive
35game of skill or chance to represent a winning or losing
36outcome.
37     8.  Is incapable of simulating or displaying rolling or
38spinning wheels.
39     9.  Is not part of an electronic network.

41     (i)  Instant bingo tickets may be dispensed, subject to the
42other provisions of this section, by an instant bingo ticket
43dispenser. An instant bingo ticket dispenser used to dispense
44such tickets is exempt from regulation under ss. 849.15 and
45849.16.
46     Section 2.  This act shall take effect July 1, 2010.
