14 | Be It Enacted by the Legislature of the State of Florida: |
15 |
|
16 | Section 1. Andrew J. Capeletti Memorial Ramp designated; |
17 | Department of Transportation to erect suitable markers.- |
18 | (1) The ramp that connects northbound Homestead Extension |
19 | of Florida's Turnpike to northbound Interstate 75 in Miami-Dade |
20 | County is designated as "Andrew J. Capeletti Memorial Ramp." |
21 | (2) The Department of Transportation is directed to erect |
22 | suitable markers designating Andrew J. Capeletti Memorial Ramp |
23 | as described in subsection (1). |
24 | Section 2. Jose Regueiro Avenue designated; Department of |
25 | Transportation to erect suitable markers.- |
26 | (1) That portion of W. 20th Avenue in the City of Hialeah |
27 | between W. 44th Place and Okeechobee Road in Miami-Dade County |
28 | is designated as "Jose Regueiro Avenue." |
29 | (2) The Department of Transportation is directed to erect |
30 | suitable markers designating Jose Regueiro Avenue as described |
31 | in subsection (1). |
32 | Section 3. Manuel Capo Boulevard designated; Department of |
33 | Transportation to erect suitable markers.- |
34 | (1) That portion of S.W. 8th Street between S.W. 24th |
35 | Avenue and S.W. 27th Avenue in Miami-Dade County is designated |
36 | as "Manuel Capo Boulevard." |
37 | (2) The Department of Transportation is directed to erect |
38 | suitable markers designating Manuel Capo Boulevard as described |
39 | in subsection (1). |
40 | Section 4. Lt. Colonel Charles Brown Memorial Highway |
41 | designated; Department of Transportation to erect suitable |
42 | markers.- |
43 | (1) That portion of U.S. Highway 1, also known as State |
44 | Road 5, between S.W. 104th Street and S.W. 112th Street in |
45 | Miami-Dade County is designated as "Lt. Colonel Charles Brown |
46 | Memorial Highway." |
47 | (2) The Department of Transportation is directed to erect |
48 | suitable markers designating Lt. Colonel Charles Brown Memorial |
49 | Highway as described in subsection (1). |
50 | Section 5. Section 17 of chapter 2008-256, Laws of |
51 | Florida, is amended to read: |
52 | Section 17. Dr. Jose A. Marques Boulevard designated; |
53 | Department of Transportation to erect suitable markers.- |
54 | (1) That portion of 8th Street between S.W. 107th Avenue |
55 | and S.W. 127th 117th Avenue in Miami-Dade County is designated |
56 | as "Dr. Jose A. Marques Boulevard." |
57 | (2) The Department of Transportation is directed to erect |
58 | suitable markers designating Dr. Jose A. Marques Boulevard as |
59 | described in subsection (1). |
60 | Section 6. That portion of S.W. 67th Avenue, also known as |
61 | Ludlam Road, between Bird Road and S.W. 136th Street in the City |
62 | of South Miami and the Village of Pinecrest in Miami-Dade County |
63 | is designated as a state historic road. No public funds shall be |
64 | expended for any of the following purposes: |
65 | (1) To cut or remove any tree having a diameter at its |
66 | thickest part in excess of 6 inches within 35 feet of either |
67 | side of the paved surface of the road or to engage in an |
68 | activity which requires the removal without the replacement of |
69 | such tree. |
70 | (2) The alteration of the physical dimensions or location |
71 | of S.W. 67th Avenue, the median strip thereof, or the land |
72 | adjacent thereto, except: |
73 | (a) Routine or emergency utilities maintenance activities |
74 | necessitated to maintain the road as a utility corridor. |
75 | (b) Modifications or improvements made to provide for |
76 | vehicular ingress and egress of governmental safety vehicles. |
77 | (c) Alterations, modifications, or improvements made for |
78 | the purpose of enhancing life safety vehicular use or pedestrian |
79 | use, or both, of S.W. 67th Avenue, as long as such alterations, |
80 | modifications, or improvements are heard in a public hearing and |
81 | subsequently approved by the governing board of the local |
82 | government in which such alterations, modifications, or |
83 | improvements are located. |
84 | (3) Nothing in this section shall be construed to prevent |
85 | the ordinary maintenance and repair of the road or structures, |
86 | provided the physical dimensions and location of the road and |
87 | the appearance of any structure are preserved. However, the |
88 | preservation of the road shall take priority over considerations |
89 | of traffic management, and the public safety shall not be |
90 | construed to require alterations in the road when alternative |
91 | means promoting safety, including more restrictive traffic |
92 | regulations, are available. |
93 | Section 7. This act shall take effect July 1, 2010. |
