2An act relating to road designations; designating Andrew
3J. Capeletti Memorial Ramp, Jose Regueiro Avenue, Manuel
4Capo Boulevard, and Lt. Colonel Charles Brown Memorial
5Highway in Miami-Dade County; amending s. 17, ch. 2008-
6256, Laws of Florida; revising the designation of Jose A.
7Marques Boulevard in Miami-Dade County; directing the
8Department of Transportation to erect suitable markers;
9designating a portion of S.W. 67th Avenue in Miami-Dade
10County as a state historic road; restricting use of public
11funds for projects related to such road; providing for
12construction; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Andrew J. Capeletti Memorial Ramp designated;
17Department of Transportation to erect suitable markers.-
18     (1)  The ramp that connects northbound Homestead Extension
19of Florida's Turnpike to northbound Interstate 75 in Miami-Dade
20County is designated as "Andrew J. Capeletti Memorial Ramp."
21     (2)  The Department of Transportation is directed to erect
22suitable markers designating Andrew J. Capeletti Memorial Ramp
23as described in subsection (1).
24     Section 2.  Jose Regueiro Avenue designated; Department of
25Transportation to erect suitable markers.-
26     (1)  That portion of W. 20th Avenue in the City of Hialeah
27between W. 44th Place and Okeechobee Road in Miami-Dade County
28is designated as "Jose Regueiro Avenue."
29     (2)  The Department of Transportation is directed to erect
30suitable markers designating Jose Regueiro Avenue as described
31in subsection (1).
32     Section 3.  Manuel Capo Boulevard designated; Department of
33Transportation to erect suitable markers.-
34     (1)  That portion of S.W. 8th Street between S.W. 24th
35Avenue and S.W. 27th Avenue in Miami-Dade County is designated
36as "Manuel Capo Boulevard."
37     (2)  The Department of Transportation is directed to erect
38suitable markers designating Manuel Capo Boulevard as described
39in subsection (1).
40     Section 4.  Lt. Colonel Charles Brown Memorial Highway
41designated; Department of Transportation to erect suitable
42markers.-
43     (1)  That portion of U.S. Highway 1, also known as State
44Road 5, between S.W. 104th Street and S.W. 112th Street in
45Miami-Dade County is designated as "Lt. Colonel Charles Brown
46Memorial Highway."
47     (2)  The Department of Transportation is directed to erect
48suitable markers designating Lt. Colonel Charles Brown Memorial
49Highway as described in subsection (1).
50     Section 5.  Section 17 of chapter 2008-256, Laws of
51Florida, is amended to read:
52     Section 17.  Dr. Jose A. Marques Boulevard designated;
53Department of Transportation to erect suitable markers.-
54     (1)  That portion of 8th Street between S.W. 107th Avenue
55and S.W. 127th 117th Avenue in Miami-Dade County is designated
56as "Dr. Jose A. Marques Boulevard."
57     (2)  The Department of Transportation is directed to erect
58suitable markers designating Dr. Jose A. Marques Boulevard as
59described in subsection (1).
60     Section 6.  That portion of S.W. 67th Avenue, also known as
61Ludlam Road, between Bird Road and S.W. 136th Street in the City
62of South Miami and the Village of Pinecrest in Miami-Dade County
63is designated as a state historic road. No public funds shall be
64expended for any of the following purposes:
65     (1)  To cut or remove any tree having a diameter at its
66thickest part in excess of 6 inches within 35 feet of either
67side of the paved surface of the road or to engage in an
68activity which requires the removal without the replacement of
69such tree.
70     (2)  The alteration of the physical dimensions or location
71of S.W. 67th Avenue, the median strip thereof, or the land
72adjacent thereto, except:
73     (a)  Routine or emergency utilities maintenance activities
74necessitated to maintain the road as a utility corridor.
75     (b)  Modifications or improvements made to provide for
76vehicular ingress and egress of governmental safety vehicles.
77     (c)  Alterations, modifications, or improvements made for
78the purpose of enhancing life safety vehicular use or pedestrian
79use, or both, of S.W. 67th Avenue, as long as such alterations,
80modifications, or improvements are heard in a public hearing and
81subsequently approved by the governing board of the local
82government in which such alterations, modifications, or
83improvements are located.
84     (3)  Nothing in this section shall be construed to prevent
85the ordinary maintenance and repair of the road or structures,
86provided the physical dimensions and location of the road and
87the appearance of any structure are preserved. However, the
88preservation of the road shall take priority over considerations
89of traffic management, and the public safety shall not be
90construed to require alterations in the road when alternative
91means promoting safety, including more restrictive traffic
92regulations, are available.
93     Section 7.  This act shall take effect July 1, 2010.
