A bill to be entitled
2An act relating to Nassau County; providing that certain
3single-family docks located in the Nassau River-St. Johns
4River Marshes Aquatic Preserve must meet specified
5criteria; authorizing the Department of Environmental
6Protection to take action against owners of docks that do
7not meet such criteria after a specified date; providing an
8effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Existing single-family docks constructed or
13permitted for construction prior to June 1, 2009, that are
14located in the Nassau River-St. Johns River Marshes Aquatic
15Preserve within Nassau County shall:
16     (1)  Be exempt from the need to obtain a permit under part
17IV of chapter 373, Florida Statutes, for the existing dock.
18     (2)  Notwithstanding the provisions of chapter 258, Florida
19Statutes, and rule 18-20, Florida Administrative Code, be
20allowed to retain a terminal platform, as defined in rule 18-20,
21Florida Administrative Code, without regard to the cumulative
22total deck and roof area, provided that by December 31, 2010,
23the owner of the riparian parcel associated with the dock
24applies for a letter of consent to use sovereignty submerged
25lands from the Department of Environmental Protection acting on
26behalf of the Board of Trustees of the Internal Improvement
27Trust fund. A letter of consent shall be issued once applicable
28criteria of this section are met.
29     (3)  Be maintained, repaired, or replaced within a
30footprint the same as or smaller than the footprint of the
31current structure in accordance with rule 18-21.004(7)(h),
32Florida Administrative Code. This subsection does not prohibit
33an owner from demolishing or removing such a dock.
34     Section 2.  Nothing in this act shall be construed to
35prevent the Department of Environmental Protection from taking
36enforcement action against the owner of the riparian parcel
37associated with a dock that does not meet the criteria of
38section 1 after December 31, 2010.
39     Section 3.  This act shall take effect upon becoming a law.
