A bill to be entitled
2An act relating to reports and functions of the Department
3of Juvenile Justice; amending s. 985.47, F.S.; deleting a
4provision that requires the Department of Juvenile Justice
5to develop an annual report on the performance of
6assessment and treatment services for serious or habitual
7juvenile offenders for delivery to the Governor and other
8designated persons by a specified date; amending s.
9985.483, F.S.; deleting a provision that requires the
10department to develop an annual report on the performance
11of assessment and treatment services of the intensive
12residential treatment program for offenders less than 13
13years of age for delivery to the Governor and other
14designated persons by a specified date; repealing s.
15985.625(5), F.S., relating to the requirement that the
16department and the Department of Education develop and
17implement an evaluation of the literacy programs for
18juvenile offenders and prepare an annual report on the
19progress of the literacy programs; repealing s. 985.636,
20F.S., relating to the authority of the Secretary of
21Juvenile Justice to designate certain persons within the
22Office of Inspector General to enforce any criminal law
23and conduct any criminal investigation that relates to
24state-operated programs or state-operated facilities over
25which the department has jurisdiction; providing an
26effective date.

28Be It Enacted by the Legislature of the State of Florida:

30     Section 1.  Paragraph (a) of subsection (8) of section
31985.47, Florida Statutes, is amended to read:
32     985.47  Serious or habitual juvenile offender.-
33     (8)  ASSESSMENT AND TREATMENT SERVICES.-Pursuant to this
34chapter and the establishment of appropriate program guidelines
35and standards, contractual instruments, which shall include
36safeguards of all constitutional rights, shall be developed as
37follows:
38     (a)  The department shall provide for:
39     1.  The oversight of implementation of assessment and
40treatment approaches.
41     2.  The identification and prequalification of appropriate
42individuals or not-for-profit organizations, including minority
43individuals or organizations when possible, to provide
44assessment and treatment services to serious or habitual
45delinquent children.
46     3.  The monitoring and evaluation of assessment and
47treatment services for compliance with this chapter and all
48applicable rules and guidelines pursuant thereto.
49     4.  The development of an annual report on the performance
50of assessment and treatment to be presented to the Governor, the
51Attorney General, the President of the Senate, the Speaker of
52the House of Representatives, and the Auditor General no later
53than January 1 of each year.
54     Section 2.  Paragraph (a) of subsection (8) of section
55985.483, Florida Statutes, is amended to read:
56     985.483  Intensive residential treatment program for
57offenders less than 13 years of age.-
58     (8)  ASSESSMENT AND TREATMENT SERVICES.-Pursuant to this
59chapter and the establishment of appropriate program guidelines
60and standards, contractual instruments, which shall include
61safeguards of all constitutional rights, shall be developed for
62intensive residential treatment programs for offenders less than
6313 years of age as follows:
64     (a)  The department shall provide for:

80no later than January 1 of each year.
81     Section 3.  Subsection (5) of section 985.625, Florida
82Statutes, is repealed.
83     Section 4.  Section 985.636, Florida Statutes, is repealed.
84     Section 5.  This act shall take effect July 1, 2010.
