1 A bill to be entitled
2 An act relating to residential fire sprinkler
3 requirements; amending s. 553.73, F.S.; prohibiting
4 incorporation into the Florida Building Code certain
5 mandatory residential fire sprinkler provisions of the
6 International Residential Code; providing an
7 exception; amending s. 633.025, F.S.; prohibiting a
8 local government from requiring property owners to
9 install fire sprinklers in residential properties
10 based on the use of that property as a rental property
11 or any change in or reclassification of the property's
12 primary use to a rental property; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (14) is added to section 553.73,
18 Florida Statutes, to read:
19 553.73 Florida Building Code.—
20 (14) The provisions of section R313 of the most current
21 version of the International Residential Code relating to
22 mandated fire sprinklers may not be incorporated into the
23 Florida Building Code as adopted by the Florida Building
24 Commission and may not be adopted as a local amendment to the
25 Florida Building Code. This subsection does not apply to a local
26 government that has a lawfully adopted ordinance relating to
27 fire sprinklers which has been in effect since January 1, 2010.
28 Section 2. Subsection (11) is added to section 633.025,
29 Florida Statutes, to read:
30 633.025 Minimum firesafety standards.—
31 (11) Notwithstanding the provisions of subsection (9), a
32 local government may not require a property owner to install
33 fire sprinklers in any residential property based on the use of
34 such property as a rental property or any change in or
35 reclassification of the property's primary use to a rental
36 property.
37 Section 3. This act shall take effect upon becoming a law.
