    1                        A bill to be entitled                      
    2         An act relating to residential fire sprinkler
    3         requirements; amending s. 553.73, F.S.; prohibiting
    4         incorporation into the Florida Building Code certain
    5         mandatory residential fire sprinkler provisions of the
    6         International Residential Code; providing an
    7         exception; amending s. 633.025, F.S.; prohibiting the
    8         requirement of property owners to install fire
    9         sprinklers in residential properties based on the use
   10         of that property as a rental property or any change in
   11         or reclassification of the property’s primary use to a
   12         rental property; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (14) is added to section 553.73,
   17  Florida Statutes, to read:
   18         553.73 Florida Building Code.—
   19         (14) The provisions of section R313 of the most current
   20  version of the International Residential Code relating to
   21  mandated fire sprinklers may not be incorporated into the
   22  Florida Building Code as adopted by the Florida Building
   23  Commission and may not be adopted as a local amendment to the
   24  Florida Building Code. This subsection does not apply to a local
   25  government that has a lawfully adopted ordinance relating to
   26  fire sprinklers which has been in effect since January 1, 2010.
   27         Section 2. Subsection (11) is added to section 633.025,
   28  Florida Statutes, to read:
   29         633.025 Minimum firesafety standards.—
   30         (11) Notwithstanding the provisions of subsection (9), a
   31  property owner shall not be required to install fire sprinklers
   32  in any residential property based on the use of such property as
   33  a rental property or any change in or reclassification of the
   34  property’s primary use to a rental property.
   35         Section 3. This act shall take effect upon becoming a law.
