    1                        A bill to be entitled                      
    2         An act relating to substantial assistance; creating s.
    3         921.186, F.S.; permitting the state attorney to
    4         request the sentencing court to reduce or suspend the
    5         sentence of a defendant who has been convicted of
    6         violating any felony offense and who provides
    7         substantial assistance in the identification, arrest,
    8         or conviction of any accomplice, accessory,
    9         coconspirator, or principal of the defendant or other
   10         felon; providing that the motion may be filed and
   11         heard in camera for good cause shown; providing that a
   12         judge may reduce or suspend the sentence if the judge
   13         finds that the defendant rendered substantial
   14         assistance; providing an effective date.

   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. Section 921.186, Florida Statutes, is created to
   19  read:
   20         921.186Substantial assistance.—Notwithstanding any other
   21  law, the state attorney may move the sentencing court at any
   22  time to reduce or suspend the sentence of any defendant who is
   23  convicted of violating any felony offense and who provides
   24  substantial assistance in the identification, arrest, or
   25  conviction of any accomplice, accessory, coconspirator, or
   26  principal of the defendant or of any other person engaged in
   27  criminal activity that would constitute a felony. Upon good
   28  cause shown, the motion may be filed and heard in camera. The
   29  judge hearing the motion may reduce or suspend the sentence if
   30  the judge finds that the defendant rendered such substantial
   31  assistance.
   32         Section 2. This act shall take effect July 1, 2010.
