A bill to be entitled
2An act relating to biomedical research; repealing s.
3381.0404, F.S., relating to the Center for Health
4Technologies; repealing s. 381.85, F.S., relating to the
5Florida Biomedical and Social Research Act; amending s.
6381.855, F.S., relating to the Florida Center for
7Universal Research to Eradicate Disease; revising advisory
8council membership to conform to changes made by the act;
9repealing s. 381.912, F.S., relating to the Cervical
10Cancer Elimination Task Force; repealing s. 381.92, F.S.,
11relating to the Florida Cancer Council; transferring and
12amending s. 381.921, F.S., relating to Florida Cancer
13Council mission and duties to conform to changes made by
14the act; amending s. 381.922, F.S., relating to the
15William G. "Bill" Bankhead, Jr., and David Coley Cancer
16Research Program, to conform to changes made by the act;
17providing an effective date.

19Be It Enacted by the Legislature of the State of Florida:
20
21     Section 1.  Section 381.0404, Florida Statutes, is
22repealed.
23     Section 2.  Section 381.85, Florida Statutes, is repealed.
24     Section 3.  Paragraph (a) of subsection (5) of section
25381.855, Florida Statutes, is amended to read:
26     381.855  Florida Center for Universal Research to Eradicate
27Disease.-
28     (5)  There is established within the center an advisory
29council that shall meet at least annually.
30     (a)  The council shall consist of one representative from a
31Florida not-for-profit institution engaged in basic and clinical
32biomedical research and education which receives more than $10
33million in annual grant funding from the National Institutes of
34Health, to be appointed by the State Surgeon General from a
35different institution each term, and one representative from and
36appointed by each of the following entities:
37     1.  Enterprise Florida, Inc.
38     2.  BioFlorida.
39     3.  The Biomedical Research Advisory Council.
40     4.  The Florida Medical Foundation.
41     5.  Pharmaceutical Research and Manufacturers of America.
42     6.  The Florida Cancer Council.
43     6.7.  The American Cancer Society, Florida Division, Inc.
44     7.8.  The American Heart Association.
45     8.9.  The American Lung Association of Florida.
46     9.10.  The American Diabetes Association, South Coastal
47Region.
48     10.11.  The Alzheimer's Association.
49     11.12.  The Epilepsy Foundation.
50     12.13.  The National Parkinson Foundation.
51     13.14.  The Florida Public Health Institute, Inc.
52     14.15.  The Florida Research Consortium.
53     Section 4.  Section 381.912, Florida Statutes, is repealed.
54     Section 5.  Section 381.92, Florida Statutes, is repealed.
55     Section 6.  Subsections (2) and (5) of section 381.922,
56Florida Statutes, are amended, and section 381.921, Florida
57Statutes is transferred to subsection (2) of that section and
58amended, to read:
59     381.922  William G. "Bill" Bankhead, Jr., and David Coley
60Cancer Research Program.-
61     (2)  The program shall provide grants for cancer research
62to further the search for cures for cancer.
63     (a)  Emphasis shall be given to the following goals
64enumerated in s. 381.921, as those goals support the advancement
65of such cures:.
66     381.921  Florida Cancer Council mission and duties.-The
67council, which shall work in concert with the Florida Center for
68Universal Research to Eradicate Disease to ensure that the goals
69of the center are advanced, shall endeavor to dramatically
70improve cancer research and treatment in this state through:
71     1.(1)  Efforts to significantly expand cancer research
72capacity in the state by:
73     a.(a)  Identifying ways to attract new research talent and
74attendant national grant-producing researchers to cancer
75research facilities in this state;
76     b.(b)  Implementing a peer-reviewed, competitive process to
77identify and fund the best proposals to expand cancer research
78institutes in this state;
79     c.(c)  Funding through available resources for those
80proposals that demonstrate the greatest opportunity to attract
81federal research grants and private financial support;
82     d.(d)  Encouraging the employment of bioinformatics in
83order to create a cancer informatics infrastructure that
84enhances information and resource exchange and integration
85through researchers working in diverse disciplines, to
86facilitate the full spectrum of cancer investigations;
87     e.(e)  Facilitating the technical coordination, business
88development, and support of intellectual property as it relates
89to the advancement of cancer research; and
90     f.(f)  Aiding in other multidisciplinary research-support
91activities as they inure to the advancement of cancer research.
92     2.(2)  Efforts to improve both research and treatment
93through greater participation in clinical trials networks by:
94     a.(a)  Identifying ways to increase adult enrollment in
95cancer clinical trials;
96     b.(b)  Supporting public and private professional education
97programs designed to increase the awareness and knowledge about
98cancer clinical trials;
99     c.(c)  Providing tools to cancer patients and community-
100based oncologists to aid in the identification of cancer
101clinical trials available in the state; and
102     d.(d)  Creating opportunities for the state's academic
103cancer centers to collaborate with community-based oncologists
104in cancer clinical trials networks.
105     3.(3)  Efforts to reduce the impact of cancer on disparate
106groups by:
107     a.(a)  Identifying those cancers that disproportionately
108impact certain demographic groups; and
109     b.(b)  Building collaborations designed to reduce health
110disparities as they relate to cancer.
111     (b)  Preference may be given to grant proposals that foster
112collaborations among institutions, researchers, and community
113practitioners, as such proposals support the advancement of
114cures through basic or applied research, including clinical
115trials involving cancer patients and related networks.
116     (5)  Funds appropriated for the William G. "Bill" Bankhead,
117Jr., and David Coley Cancer Research Program shall be
118distributed pursuant to this section to provide grants to
119researchers seeking cures for cancer and cancer-related
120illnesses, with emphasis given to the goals enumerated in this
121section s. 381.921. From the total funds appropriated, an amount
122of up to 10 percent may be used for administrative expenses. In
123the 2009-2010 fiscal year, 2.5 percent, not to exceed $25
124million, of the revenue deposited into the Health Care Trust
125Fund pursuant to s. 215.5602(12)(a) shall be transferred to the
126Biomedical Research Trust Fund within the Department of Health
127for the William G. "Bill" Bankhead, Jr., and David Coley Cancer
128Research Program.
129     Section 7.  This act shall take effect July 1, 2010.
