    1                        A bill to be entitled                      
    2         An act relating to sexual offenses involving the
    3         Internet; creating s. 794.067, F.S.; prohibiting
    4         persons convicted of certain sexual offenses involving
    5         the Internet from accessing the Internet or
    6         maintaining or contracting for access to the Internet;
    7         providing an employment exception; providing criminal
    8         penalties; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 794.067, Florida Statutes, is created to
   13  read:
   14         794.067 Persons convicted of certain offenses; prohibition
   15  on Internet access.—
   16         (1)(a) Except as provided in paragraph (b), a person who is
   17  convicted of or who pleads guilty or nolo contendere to,
   18  regardless of adjudication, any violation of this chapter,
   19  chapter 800, chapter 827, or chapter 847 who used the Internet
   20  in the commission of that violation shall be prohibited from the
   21  following:
   22         1. Maintaining, contracting for, or accessing in any way an
   23  Internet connection in his or her home, residence, or principal
   24  place of abode.
   25         2. Maintaining, contracting for, or accessing in any way a
   26  wireless Internet connection in any location for any purpose.
   27         (b) A person subject to paragraph (a) is not prohibited
   28  from maintaining, contracting for, or accessing an Internet
   29  connection for the sole purpose of or requirements for his or
   30  her employment.
   31         (2) A person who violates this section commits a felony of
   32  the third degree, punishable as provided in s. 775.082, s.
   33  775.083, or s. 775.084.
   34         Section 2. This act shall take effect October 1, 2010.
