    1                        A bill to be entitled                      
    2         An act relating to drivers’ licenses; amending s.
    3         322.142, F.S.; authorizing the Department of Highway
    4         Safety and Motor Vehicles to release copies of
    5         drivers’ licenses to the Department of Children and
    6         Family Services for certain purposes relating to
    7         public assistance; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (4) of section 322.142, Florida
   12  Statutes, is amended to read:
   13         322.142 Color photographic or digital imaged licenses.—
   14         (4) The department may maintain a film negative or print
   15  file. The department shall maintain a record of the digital
   16  image and signature of the licensees, together with other data
   17  required by the department for identification and retrieval.
   18  Reproductions from the file or digital record are exempt from
   19  the provisions of s. 119.07(1) and shall be made and issued only
   20  for departmental administrative purposes; for the issuance of
   21  duplicate licenses; in response to law enforcement agency
   22  requests; to the Department of State pursuant to an interagency
   23  agreement to facilitate determinations of eligibility of voter
   24  registration applicants and registered voters in accordance with
   25  ss. 98.045 and 98.075; to the Department of Revenue pursuant to
   26  an interagency agreement for use in establishing paternity and
   27  establishing, modifying, or enforcing support obligations in
   28  Title IV-D cases; to the Department of Children and Family
   29  Services pursuant to an interagency agreement to conduct
   30  protective investigations under part III of chapter 39, for use
   31  as verification of identity to expedite the determination of
   32  eligibility for public assistance, or for use in public
   33  assistance fraud investigations; or to the Department of
   34  Financial Services pursuant to an interagency agreement to
   35  facilitate the location of owners of unclaimed property, the
   36  validation of unclaimed property claims, and the identification
   37  of fraudulent or false claims.
   38         Section 2. This act shall take effect July 1, 2010.
