A bill to be entitled
2An act relating to trust funds; creating the Sustainable
3and Renewable Energy Policy Trust Fund within the Florida
4Energy Office of the Department of Environmental
5Protection; providing for sources of funds and purposes;
6providing for annual carryforward of funds; providing for
7the future review and termination or re-creation of the
8trust fund; providing a contingent effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  (1)  The Sustainable and Renewable Energy
13Policy Trust Fund is created within the Florida Energy Office of
14the Department of Environmental Protection. The trust fund shall
15be administered by the head of the office or his or her
16designee. Funds allocated to the trust fund include funds
17received from state appropriations, federal and state grants,
18and deposits consisting of the monthly systems benefits charge
19collected by the electric utilities in the state from every
20residential, commercial, and industrial consumer of electric
21service for deposit into the trust fund. The funds in the trust
22fund shall be used to support the activities of the direct-
23support organization of the office relating to sustainable and
24renewable energy projects in this state.
25     (2)  Notwithstanding s. 216.301, Florida Statutes, and
26pursuant to s. 216.351, Florida Statutes, any balance in the
27trust fund at the end of any fiscal year shall remain in the
28trust fund and shall be available for carrying out the purposes
29of the trust fund.
30     (3)  In accordance with s. 19(f)(2), Article III of the
31State Constitution, the trust fund shall, unless terminated
32sooner, be terminated on July 1, 2014. Before its scheduled
33termination, the trust fund shall be reviewed as provided in s.
34215.3206(1) and (2), Florida Statutes.
35     Section 2.  This act shall take effect on the same date
36that House Bill 29C or similar legislation takes effect, if such
37legislation is adopted in the same legislative session or an
38extension thereof and becomes law.
