House Joint Resolution
2A joint resolution proposing an amendment to Section 7 of
3Article II of the State Constitution to prohibit oil
4exploration, drilling, extraction, and production in
5specified coastal waters and to exempt the transportation
6of oil products produced outside of such waters.

8Be It Resolved by the Legislature of the State of Florida:

10     That the following amendment to Section 7 of Article II of
11the State Constitution is agreed to and shall be submitted to
12the electors of this state for approval or rejection at the next
13general election or at an earlier special election specifically
14authorized by law for that purpose:

GENERAL PROVISIONS
17     SECTION 7.  Natural resources and scenic beauty.-
18     (a)  It shall be the policy of the state to conserve and
19protect its natural resources and scenic beauty. Adequate
20provision shall be made by law for the abatement of air and
21water pollution and of excessive and unnecessary noise and for
22the conservation and protection of natural resources.
23     (b)  Those in the Everglades Agricultural Area who cause
24water pollution within the Everglades Protection Area or the
25Everglades Agricultural Area shall be primarily responsible for
26paying the costs of the abatement of that pollution. For the
27purposes of this subsection, the terms "Everglades Protection
28Area" and "Everglades Agricultural Area" shall have the meanings
29as defined in statutes in effect on January 1, 1996.
30     (c)  To protect the citizens of the state and their
31environment, oil exploration, drilling, extraction, and
32production are prohibited in and beneath all state waters
33between the line of mean high tide and the outermost boundaries
34of the state's territorial seas. This prohibition shall not
35apply to the transportation of oil products produced outside of
36such waters.
37     BE IT FURTHER RESOLVED that the following statement be
38placed on the ballot:

41     OIL EXPLORATION, DRILLING, EXTRACTION, AND PRODUCTION IN
42COASTAL WATERS PROHIBITED.-Proposing an amendment to the State
43Constitution to prohibit oil exploration, drilling, extraction,
44and production in and beneath all state waters between the line
45of mean high tide and the outermost boundaries of the state's
46territorial seas and to exempt the transportation of oil
47products produced outside of such waters from the prohibition.
