| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |

| 10 | Section 1. Subsection (5) is added to section 447.307, |
| 11 | Florida Statutes, to read: |
| 12 | 447.307 Certification of employee organization.- |
| 13 | (5) A certified bargaining agent that represents less than |
| 14 | 50 percent of the employees eligible for representation as |
| 15 | employee organization members must recertify the employee |
| 16 | organization as the exclusive collective bargaining |
| 17 | representative of all employees in the unit, pursuant to this |
| 18 | section, by July 1, 2011, or the certification of the employee |
| 19 | organization as the exclusive bargaining agent for the employees |
| 20 | in the bargaining unit is revoked. This subsection does not |
| 21 | apply to an employee organization, however organized or |
| 22 | constituted, that represents, or seeks to represent, employees |
| 23 | who are law enforcement officers, as defined in s. 943.10(1), or |
| 24 | firefighters, as defined in s. 633.30(1). |
| 25 | Section 2. This act shall take effect upon becoming a law. |
