3     Amendment
4     Between lines 514 and 515, insert:
5     Section 24. Subsection (3) and paragraph (b) of subsection
6(6) of section 983.13, Florida Statutes, are amended, and
7subsection (11) is added to that section, to read:
8     893.13  Prohibited acts; penalties.--
9     (3)  Any person who delivers, without consideration, not
10more than 20 grams of cannabis, as defined in this chapter,
11commits a misdemeanor of the second first degree, punishable as
12provided in s.775.082, and shall be ordered to pay a fine of
13$500 in addition to any fine pursuant to or s.775.083. For
14purposes of this paragraph, "cannabis" does not include the
15resin extracted from the plants of the genus Cannabis or any
16compound manufacture, salt, derivative, mixture or preparation
17of such resin. The clerk shall remit 50 percent of the fines
18imposed under this subsection to the Department of Revenue for
19deposit into the General Revenue Fund. It is the intent of the
20Legislature that, to the greatest extent appropriate, a person
21be issued a notice to appear for violations of this subsection.

23     (b)  If the offense is the possession of mot more the 20
24grams of cannabis, as defined in this chapter, the person
25commits a misdemeanor of the second first degree, punishable as
26provided in s. 775.082 and shall be ordered to pay a fine of
27$500 in addition to any fine imposed pursuant to or s. 775.083.
28For the purpose of this e=subsection, "cannabis" does not
29include the  resin extracted from the plants of the genus
30Cannabis, or any compound manufacture, salt, derivative, mixture
31or preparation of such resin. The clerk shall remit 50 percent
32of the fines imposed under this subsection to the Department of
33Revenue for deposit into the General Revenue Fund. It is the
34intent of the legislature that, to the greatest extent
35appropriate, a person be issued a notice to appear for
36violations of this paragraph.
37     (11)  It is the intent of the Legislature that, to the
38greatest extent appropriate, a person be issued a notice to
39appear for misdemeanor violations of this section.
