    1                        A bill to be entitled                      
    2         An act relating to trust funds; amending s. 455.116,
    3         F.S.; providing a statutory reference for the trust
    4         fund created by the act; creating s. 499.0031, F.S.;
    5         creating the Florida Drug, Device, and Cosmetic Trust
    6         Fund within the Department of Business and
    7         Professional Regulation; providing for the purpose of
    8         the trust fund and sources of funds; providing for
    9         future review and termination or re-creation of the
   10         trust fund; providing an effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (8) is added to section 455.116,
   15  Florida Statutes, to read:
   16         455.116 Regulation trust funds.—The following trust funds
   17  shall be placed in the department:
   18         (8) Florida Drug, Device, and Cosmetic Trust Fund.
   19         Section 2. Section 499.0031, Florida Statutes, is created
   20  to read:
   21         499.0031 Florida Drug, Device, and Cosmetic Trust Fund.—
   22         (1) The Florida Drug, Device, and Cosmetic Trust Fund is
   23  created within the Department of Business and Professional
   24  Regulation.
   25         (2) Funds to be credited to and uses of the trust fund
   26  shall be administered in accordance with the provisions of
   27  chapter 499. Funds shall be expended only pursuant to
   28  legislative appropriation or an approved amendment to the
   29  department’s operating budget pursuant to the provisions of
   30  chapter 216, Florida Statutes.
   31         (3) In accordance with s. 19(f)(2), Article III of the
   32  State Constitution, the Florida Drug, Device, and Cosmetic Trust
   33  Fund shall, unless terminated sooner, be terminated on July 1,
   34  2015. Before its scheduled termination, the trust fund shall be
   35  reviewed as provided in s. 215.3206(1) and (2), Florida
   36  Statutes.
   37         Section 3. This act shall take effect July 1, 2011, except
   38  that this act shall not take effect unless it is enacted by a
   39  three-fifths vote of the membership of each house of the
   40  Legislature.
