    1                        A bill to be entitled                      
    2         An act relating to public K-12 health education;
    3         amending s. 1003.46, F.S.; deleting the requirement
    4         that schools teach abstinence from sexual activity
    5         outside of marriage as the expected standard for all
    6         school-age students as part of instruction in human
    7         sexuality; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (2) of section 1003.46, Florida
   12  Statutes, is amended to read:
   13         1003.46 Health education; instruction in acquired immune
   14  deficiency syndrome.—
   15         (2) Throughout instruction in acquired immune deficiency
   16  syndrome, sexually transmitted diseases, or health education,
   17  when such instruction and course material contains instruction
   18  in human sexuality, a school shall:
   19         (a) Teach abstinence from sexual activity outside of
   20  marriage as the expected standard for all school-age students
   21  while teaching the benefits of monogamous heterosexual marriage.
   22         (a)(b) Emphasize that abstinence from sexual activity is a
   23  certain way to avoid out-of-wedlock pregnancy, sexually
   24  transmitted diseases, including acquired immune deficiency
   25  syndrome, and other associated health problems.
   26         (b)(c) Teach that each student has the power to control
   27  personal behavior and encourage students to base actions on
   28  reasoning, self-esteem, and respect for others.
   29         (c)(d) Provide instruction and material that is appropriate
   30  for the grade and age of the student.
   31         Section 2. This act shall take effect July 1, 2011.
