    1                        A bill to be entitled                      
    2         An act relating to columbaria; amending s. 497.260,
    3         F.S.; exempting from regulation certain columbaria
    4         located on a motorsports entertainment complex;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Paragraph (j) is added to subsection (1) of
   10  section 497.260, Florida Statutes, to read:
   11         497.260 Cemeteries; exemption; investigation and
   12  mediation.—
   13         (1) The provisions of this chapter relating to cemeteries
   14  and all rules adopted pursuant thereto shall apply to all
   15  cemeteries except for:
   16         (j) A columbarium consisting of 5 acres or less which is
   17  located on a motorsports entertainment complex as defined in s.
   18  549.10. The motorsports entertainment complex that establishes
   19  the columbarium shall ensure that the columbarium is constructed
   20  and perpetually kept and maintained in a manner consistent with
   21  subsection (2) and the intent of this chapter.
   22         Section 2. This act shall take effect July 1, 2011.
