       The Committee on Governmental Oversight and Accountability
       (Bogdanoff) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 389 and 390
    4  insert:
    5         Section 7. Subsection (5) of section 316.2065, Florida
    6  Statutes, is amended to read:
    7         316.2065 Bicycle regulations.—
    8         (5)(a) Any person operating a bicycle upon a roadway at
    9  less than the normal speed of traffic at the time and place and
   10  under the conditions then existing shall ride in the lane marked
   11  for bicycle use or, if no lane is marked for bicycle use, as
   12  close as practicable to the right-hand curb or edge of the
   13  roadway except under any of the following situations:
   14         1. When overtaking and passing another bicycle or vehicle
   15  proceeding in the same direction.
   16         2. When preparing for a left turn at an intersection or
   17  into a private road or driveway.
   18         3. When reasonably necessary to avoid any condition or
   19  potential conflict, including, but not limited to, a fixed or
   20  moving object, parked or moving vehicle, bicycle, pedestrian,
   21  animal, surface hazard, turn lane, or substandard-width lane,
   22  which that makes it unsafe to continue along the right-hand curb
   23  or edge or within a bicycle lane. For the purposes of this
   24  subsection, a “substandard-width lane” is a lane that is too
   25  narrow for a bicycle and another vehicle to travel safely side
   26  by side within the lane.
   27         (b) Any person operating a bicycle upon a one-way highway
   28  with two or more marked traffic lanes may ride as near the left
   29  hand curb or edge of such roadway as practicable.

   33         Delete line 22
   34  and insert:
   35         conforming a reference; amending s. 316.2065, F.S.;
   36         clarifying provisions relating to when a bicycle
   37         operator must ride in a bicycle lane or along the curb
   38         or edge of the roadway; amending s. 316.2085, F.S.;
