       Senator Braynon moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1841 and 1842
    4  insert:
    5         Section 39. Section 320.08051, Florida Statutes, is created
    6  to read:
    7         320.08051 Specialty license plates.—
    8         (1) Notwithstanding any provisions of law to the contrary,
    9  any application for a specialty license plate shall be deemed
   10  approved if the application has:
   11         (a) Been determined by the Auditor General to be an
   12  exception to the specialty license plate moratorium established
   13  by the provisions of s. 45 of chapter 2008-176, Laws of Florida;
   14         (b) Complied with all requirements under s. 320.08053; and
   15         (c) Been considered affirmatively by a legislative
   16  committee and at least one chamber of the Legislature prior to
   17  December 31, 2010.
   18         (2) Once approved, the organization must submit to the
   19  department the proposed art design for the specialty license
   20  plate, in a medium prescribed by the department, together with a
   21  planned distribution of proceeds, as soon as practicable, but no
   22  later than September 1, 2011.
   23         (3) The department shall begin production of any specialty
   24  license plate deemed approved under this section within 1 year
   25  after July 1, 2011.
   26         (4) The license plate annual use fee is $25, which shall be
   27  distributed to the organization sponsoring the application for
   28  the specialty license plate. The sponsoring organization may not
   29  use more than 10 percent of the proceeds for marketing and
   30  administration.
   31         (5) All other requirements pertaining to specialty license
   32  plates contained in ss. 320.08056 and 320.08058 apply to the
   33  specialty license plates approved pursuant to this section.

   39         creating s. 320.08051, F.S.; providing for the
   40         approval of certain specialty license plate
   41         applications; providing conditions; requiring the
   42         organization to submit certain information to the
   43         department for the specialty plate; requiring the
   44         department to begin production of any approved
   45         specialty plate within a certain time; providing for a
   46         fee; requiring compliance with all other provisions
   47         relating to specialty plates;
