Florida Senate - 2011 SB 1162 By Senator Storms 10-01065-11 20111162__ 1 A bill to be entitled 2 An act relating to obscenity; amending s. 847.001, 3 F.S.; revising the definition of the term “sexual 4 conduct” for purposes of provisions relating to 5 obscenity to include certain forms of simulated 6 conduct; providing an effective date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Subsection (16) of section 847.001, Florida 11 Statutes, is amended to read: 12 847.001 Definitions.—As used in this chapter, the term: 13 (16) “Sexual conduct” means actual or simulated sexual 14 intercourse, deviate sexual intercourse, sexual bestiality, 15 masturbation, or sadomasochistic abuse; actual or simulated lewd 16 exhibition of the genitals; actual or simulated physical contact 17 with a person’s clothed or unclothed genitals, pubic area, 18 buttocks, or, if such person is a female, breast with the intent 19 to arouse or gratify the sexual desire of either party; or any 20 actual or simulated act or conduct which constitutes sexual 21 battery or simulates that sexual battery is being or will be 22 committed. A mother’s breastfeeding of her baby does not under 23 any circumstance constitute “sexual conduct.” 24 Section 2. This act shall take effect July 1, 2011.
