3     Amendment to Amendment (397883) (with title amendment)
4     Between lines 181 and 182, insert:
5     Section 106.  Section 400.0246, Florida Statutes, is
6created to read:
7     400.0246  Reporting of criminal conduct on premises;
8destruction of evidence prohibited.-An employee or officer of a
9nursing home shall report any criminal conduct witnessed or
10learned of subsequent to its occurrence to local law enforcement
11prior to reporting the conduct to the employer, a supervisor, or
12a director. Every effort must be made to preserve all evidence
13relating to the crime. Any person who destroys evidence commits
14a felony of the third degree, punishable as provided in s.
15775.082, s. 775.083, or s. 775.084.
