5 | Section 107. Subsection (1) of section 400.151, Florida |
6 | Statutes, is amended to read: |
7 | 400.151 Contracts.- |
8 | (1) Effective October 1, 2011, the presence of each |
9 | resident in a facility shall be covered by a state-approved |
10 | contract, executed by the licensee and the resident or his or |
11 | her designee or legal representative at the time of admission or |
12 | prior thereto and at the expiration of the term of a previous |
13 | contract, and modified by the licensee and the resident or his |
14 | or her designee or legal representative at the time the source |
15 | of payment for the resident's care changes. Each party to the |
16 | contract is entitled to a duplicate original thereof, printed in |
17 | boldfaced type, and the licensee shall keep on file all |
18 | contracts which it has with residents. The licensee may not |
19 | destroy or otherwise dispose of any such contract until 5 years |
20 | after its expiration or such longer period as may be provided in |
21 | the rules of the agency. Microfilmed records or records |
22 | reproduced by a similar process of duplication may be kept in |
23 | lieu of the original records. |
