       Senator Latvala moved the following:
       
    1         Senate Substitute for Amendment (560380) (with title

    5  insert:
    6         Section 95. Subsection (1) of section 483.245, Florida
    7  Statutes, is amended to read:
    8         483.245 Rebates prohibited; penalties.—
    9         (1) It is unlawful for any person to pay or receive any
   10  commission, bonus, kickback, or rebate or engage in any split
   11  fee arrangement in any form whatsoever with any dialysis
   12  facility, physician, surgeon, organization, agency, or person,
   13  either directly or indirectly, for patients referred to a
   14  clinical laboratory licensed under this part. A clinical
   15  laboratory licensed under this part is prohibited from placing,
   16  directly or indirectly, through an independent staffing company,
   17  lease arrangement, or otherwise, a specimen collector or other
   18  personnel in any physician’s office, unless the clinical lab and
   19  the physician’s office are owned and operated by the same
   20  entity.

   23         And the title is amended as follows:
   24         Delete line 4989
   25  and insert:
   26         laboratory licensure; amending s. 483.245, F.S.;
   27         prohibiting certain clinical laboratories from placing
   28         a specimen collector or other personnel in a
   29         physician’s office, unless the clinical lab and the
   30         physician’s office are owned and operated by the same
   31         entity; amending s. 483.294, F.S.;
