2An act relating to veterinary practice; amending 474.202,
3F.S.; defining the term "limited service veterinary
4vaccination clinic"; amending s. 474.215, F.S.; revising
5terminology; requiring that the Board of Veterinary
6Medicine establish minimum standards for limited service
7veterinary vaccination clinics rather than limited service
8veterinary medical practices; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (6) of section 474.202, Florida
13Statutes, is amended to read:
14     474.202  Definitions.-As used in this chapter:
15     (6)  "Limited-service veterinary vaccination clinic medical
16practice" means a veterinary practice at which a veterinarian
17performs vaccinations or immunizations on multiple animals at a
18temporary location and operates for a limited time offering or
19providing veterinary services at any location that has a primary
20purpose other than that of providing veterinary medical service
21at a permanent or mobile establishment permitted by the board;
22provides veterinary medical services for privately owned animals
23that do not reside at that location; operates for a limited
24time; and provides limited types of veterinary medical services.
25     Section 2.  Subsection (7) of section 474.215, Florida
26Statutes, is amended to read:
27     474.215  Premises permits.-
28     (7)  The board by rule shall establish minimum standards
29for the operation of limited service veterinary vaccination
30clinics medical practices. Such rules shall not restrict limited
31service veterinary medical practices and shall be consistent
32with the type of limited veterinary vaccination and immunization
33services medical service provided.
34     (a)  Any person that offers or provides limited service
35veterinary vaccination clinics medical practice shall obtain a
36biennial permit from the board the cost of which shall not
37exceed $250. The limited service permittee shall register each
38location where a limited service veterinary vaccination clinic
39is held and shall pay a fee set by rule not to exceed $25 to
40register each such location.
41     (b)  All permits issued under this subsection are subject
42to the provisions of ss. 474.213 and 474.214.
43     (c)  Notwithstanding any provision of this subsection to
44the contrary, any temporary rabies vaccination effort operated
45by a county health department in response to a public health
46threat, as declared by the State Health Officer in consultation
47with the State Veterinarian, is not subject to any
48preregistration, time limitation, or fee requirements, but must
49adhere to all other requirements for limited service veterinary
50vaccination clinics medical practice as prescribed by rule. The
51fee charged to the public for a rabies vaccination administered
52during such temporary rabies vaccination effort may not exceed
53the actual cost of administering the rabies vaccine. Such rabies
54vaccination efforts may not be used for any purpose other than
55to address the public health consequences of the rabies
56outbreak. The board shall be immediately notified in writing of
57any temporary rabies vaccination effort operated under this
58paragraph.
59     Section 3.  This act shall take effect July 1, 2011.
