    1                        A bill to be entitled                      
    2         An act relating to mold-related services; repealing
    3         part XVI of chapter 468, F.S., relating to the mold
    4         related services licensing program of the Department
    5         of Business and Professional Regulation, the
    6         regulation of mold assessment and mold remediation,
    7         the examination, licensure, continuing education, and
    8         discipline of mold assessors and mold remediators, and
    9         the certification of corporations and partnerships
   10         offering mold assessment or mold remediation to the
   11         public; amending ss. 20.165 and 455.2123, F.S.;
   12         conforming provisions; providing an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Part XVI of chapter 468, Florida Statutes,
   17  consisting of sections 468.84, 468.841, 468.8411, 468.8412,
   18  468.8413, 468.8414, 468.8415, 468.8416, 468.8417, 468.8418,
   19  468.8419, 468.842, 468.8421, 468.8422, 468.8423, and 468.8424,
   20  is repealed.
   21         Section 2. Paragraph (a) of subsection (4) of section
   22  20.165, Florida Statutes, is amended to read:
   23         20.165 Department of Business and Professional Regulation.
   24  There is created a Department of Business and Professional
   25  Regulation.
   26         (4)(a) The following boards and programs are established
   27  within the Division of Professions:
   28         1. Board of Architecture and Interior Design, created under
   29  part I of chapter 481.
   30         2. Florida Board of Auctioneers, created under part VI of
   31  chapter 468.
   32         3. Barbers’ Board, created under chapter 476.
   33         4. Florida Building Code Administrators and Inspectors
   34  Board, created under part XII of chapter 468.
   35         5. Construction Industry Licensing Board, created under
   36  part I of chapter 489.
   37         6. Board of Cosmetology, created under chapter 477.
   38         7. Electrical Contractors’ Licensing Board, created under
   39  part II of chapter 489.
   40         8. Board of Employee Leasing Companies, created under part
   41  XI of chapter 468.
   42         9. Board of Landscape Architecture, created under part II
   43  of chapter 481.
   44         10. Board of Pilot Commissioners, created under chapter
   45  310.
   46         11. Board of Professional Engineers, created under chapter
   47  471.
   48         12. Board of Professional Geologists, created under chapter
   49  492.
   50         13. Board of Veterinary Medicine, created under chapter
   51  474.
   52         14. Home inspection services licensing program, created
   53  under part XV of chapter 468.
   54         15. Mold-related services licensing program, created under
   55  part XVI of chapter 468.
   56         Section 3. Section 455.2123, Florida Statutes, is amended
   57  to read:
   58         455.2123 Continuing education.—A board, or the department
   59  when there is no board, may provide by rule that distance
   60  learning may be used to satisfy continuing education
   61  requirements. A board, or the department when there is no board,
   62  shall approve distance learning courses as an alternative to
   63  classroom courses to satisfy continuing education requirements
   64  provided for in part VIII or, part XV, or part XVI of chapter
   65  468 or part I or part II of chapter 475 and may not require
   66  centralized examinations for completion of continuing education
   67  requirements for the professions licensed under part VIII or,
   68  part XV, or part XVI of chapter 468 or part I or part II of
   69  chapter 475.
   70         Section 4. This act shall take effect July 1, 2011.
