House Comm: RCS . 03/21/2011 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Agriculture (Hays) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. (1) Any person, except an employee or agent of 6 the Department of Agriculture and Consumer Services acting 7 pursuant to s. 570.15, Florida Statutes, or a law enforcement 8 officer conducting a lawful inspection or investigation, who 9 enters onto a farm or other property where legal agriculture 10 operations are being conducted and produces audio or video 11 records without the written consent of the owner or an 12 authorized representative of the owner, commits a felony of the 13 first degree, punishable as provided in s. 775.082, s. 775.083, 14 or s. 775.084, Florida Statutes. 15 (2) As used in this section, the term: 16 (a) “Audio or video records” means any audio or video 17 recording, regardless of the recording medium or format, 18 including, but not limited to, photographs, audio or videotapes, 19 cd’s, dvd’s, or streaming media, whether stored on film stock, 20 hard disks, solid state storage, or any electrical, magnetic, or 21 optical or other form of data storage. 22 (b) “Farm” means any tract of land cultivated for the 23 purpose of agricultural production, the raising and breeding of 24 domestic animals, or the storage of a commodity. 25 Section 2. This act shall take effect July 1, 2011. 26 27 ================= T I T L E A M E N D M E N T ================ 28 And the title is amended as follows: 29 Delete everything before the enacting clause 30 and insert: 31 A bill to be entitled 32 An act relating to farms; prohibiting a person from 33 entering onto a farm and making any audio record, 34 photograph, or video record at the farm without the 35 owner’s written consent; providing exceptions; 36 providing definitions; providing penalties; providing 37 an effective date.
