8 | district office; requiring the Chief Financial Officer or |
9 | the governing body of a county, municipality, or special |
10 | district, as appropriate, to withhold salary payments it |
11 | would otherwise make to an elected officeholder when that |
12 | official owes a fine to the Commission on Ethics or the |
13 | Elections Commission; authorizing the Chief Financial |
14 | Officer and governing bodies to retain a portion of the |
15 | payment to cover their administrative costs; providing an |
16 | effective date. |

18 | Be It Enacted by the Legislature of the State of Florida: |

20 | Section 1. Payment of unpaid fines by elected officials.- |
21 | (1) The Commission on Ethics and the Elections Commission |
22 | shall notify the Chief Financial Officer or the governing body |
23 | of a county, municipality, or special district, as appropriate, |
24 | of any fines owed to the Commission on Ethics or the Elections |
25 | Commission by a person who has been elected to a state, county, |
26 | municipal, or special district office. |
27 | (2) The Chief Financial Officer or the governing body of a |
28 | county, municipality, or special district, as appropriate, shall |
29 | withhold any salary payments, less applicable state and federal |
30 | taxes, which it would otherwise pay to a person elected to a |
31 | state, county, municipal, or special district office when that |
32 | person owes a fine to the Commission on Ethics or to the |
33 | Elections Commission. The salary payments withheld shall be |
34 | remitted to the commission that is owed the fine until the fine |
35 | is satisfied. |
36 | (3) The Chief Financial Officer or the governing body of a |
37 | county, municipality, or special district may retain up to 2 |
38 | percent of each payment made pursuant to this section to cover |
39 | its administrative costs. |
40 | Section 2. This act shall take effect July 1, 2011. |
