House Comm: RCS . 04/18/2011 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Budget (Siplin) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete line 299 4 and insert: 5 Section 9. This section shall take effect upon this act 6 becoming a law and, within 30 days thereafter, the Department of 7 Education, in consultation with the Department of Agriculture 8 and Consumer Services, shall develop and submit to the United 9 States Department of Agriculture a request for a waiver required 10 to transfer administration of the school food service and 11 nutrition programs from the Department of Education to the 12 Department of Agriculture and Consumer Services. Upon receipt of 13 the United States Department of Agriculture’s approval or denial 14 of the request for a waiver, the Department of Education shall 15 immediately notify in writing the Governor, the President of the 16 Senate, and the Speaker of the House of Representatives 17 regarding the decision of the United States Department of 18 Agriculture. The notification shall include a copy of the United 19 States Department of Agriculture’s approval or denial of the 20 request for a waiver. 21 Section 10. Except as otherwise expressly provided in this 22 act and except for this section, which shall take effect upon 23 this act becoming a law, this act shall take effect January 1, 24 2012, if the United States Department of Agriculture approves 25 the request for a waiver, pursuant to section 9 of this act, on 26 or before November 1, 2011. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 Delete line 42 31 and insert: 32 requiring the Department of Education, in consultation 33 with the Department of Agriculture and Consumer 34 Services, to develop and submit a request for a waiver 35 to the United States Department of Agriculture to 36 transfer administration of the school food service and 37 nutrition programs; requiring the Department of 38 Education to notify the Governor and the Legislature 39 regarding the decision of the United States Department 40 of Agriculture; providing for contingent effect based 41 upon federal approval of a request for a waiver; 42 providing effective dates.
