       The Committee on Criminal Justice (Margolis) recommended the
       following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 594 - 605
    4  and insert:
    5         (6) A mixture, as defined in s. 893.02, containing any
    6  controlled substance described in this section includes, but is
    7  not limited to, a solution or a dosage unit, including but not
    8  limited to, a pill or tablet, containing a controlled substance.
    9  For the purpose of clarifying legislative intent regarding the
   10  weighing of a mixture containing a controlled substance
   11  described in this section, the weight of the controlled
   12  substance is the total weight of the mixture, including the
   13  controlled substance and any other substance in the mixture.
   14  However, if the mixture is a prescription drug as defined in s.
   15  499.003(43) and the weight of the controlled substance can be
   16  identified using the national drug code, the weight of the
   17  controlled substance may not include any other substance in the
   18  mixture. If there is more than one mixture containing the same
   19  controlled substance, the weight of the controlled substance is
   20  calculated by aggregating the total weight of each mixture.
