6 | Section 79. Subsections (5), (6), and (7) are added to |
7 | section 316.0083, Florida Statutes, to read: |
8 | 316.0083 Mark Wandall Traffic Safety Program; |
9 | administration; report.- |
10 | (5) Prior to installing a traffic infraction detector, the |
11 | department, a county, or a municipality must request that the |
12 | Department of Transportation perform a safety hazard study for |
13 | the intersection. The department, a county, or a municipality |
14 | shall be responsible for the cost of the study. A traffic |
15 | infraction detector may not be installed until the Department of |
16 | Transportation has performed the study and determined that the |
17 | intersection warrants a traffic infraction detector. |
18 | (6) A safety hazard study required under this section |
19 | shall evaluate the safety of an intersection within a 6-month |
20 | period. A safety hazard exists if, at the end of the study |
21 | period, the Department of Transportation identifies a |
22 | statistically disproportionate number of motor vehicle crashes |
23 | at the intersection, greater than that of similarly situated |
24 | intersections in the county or municipality. |
25 | (7) Notwithstanding subsection (1), the department, a |
26 | county, or a municipality may not use a traffic infraction |
27 | detector to enforce a violation of s. 316.075(1)(c)1. when a |
28 | driver is making a right turn or when a driver is making a left |
29 | turn from a one-way street onto a one-way street. |
