Senator Joyner moved the following:

6 Section 38. Subsection (1) of section 101.657, Florida
7 Statutes, is amended to read:
8 101.657 Early voting.—
9 (1)(a) As a convenience to the voter, the supervisor of
10 elections shall allow an elector to vote early in the main or
11 branch office of the supervisor. The supervisor shall mark,
12 code, indicate on, or otherwise track the voter’s precinct for
13 each early voted ballot. In order for a branch office to be used
14 for early voting, it shall be a permanent facility of the
15 supervisor and shall have been designated and used as such for
16 at least 1 year prior to the election.
17 (b) The supervisor shall also designate any city hall as an
18 early voting site. The supervisor may also designate any
19 permanent public library facility, any polling place to be used
20 on election day, any college or university, or any other
21 facility open to the public as an early voting site. In any
22 general election in which a candidate for President of the
23 United States appears on the ballot, the supervisor of elections
24 shall designate at least one early voting site for every 40,000
25 registered voters within the county. In any general election in
26 which a candidate for President of the United States does not
27 appear on the ballot, the supervisor shall designate at least
28 one early voting site for every 80,000 registered voters within
29 the county. To the extent practicable, the designated sites must
30 be geographically located so as to provide all voters in the
31 county an equal opportunity to cast a ballot. The supervisor may
32 also designate any city hall or permanent public library
33 facility as early voting sites; however, if so designated, the
34 sites must be geographically located so as to provide all voters
35 in the county an equal opportunity to cast a ballot, insofar as
36 is practicable. The results or tabulation of votes cast during
37 early voting may not be made before the close of the polls on
38 election day. Results shall be reported by precinct.
39 (c)(b) The supervisor shall designate each early voting
40 site by no later than the 30th day prior to an election and
41 shall designate an early voting area, as defined in s. 97.021,
42 at each early voting site.
43 (d)(c) All early voting sites in a county shall be open on
44 the same days for the same amount of time and shall allow any
45 person in line at the closing of an early voting site to vote.
46 (e)(d) Early voting shall begin on the 15th day before an
47 election and end on the 2nd day before an election. For purposes
48 of a special election held pursuant to s. 100.101, early voting
49 shall begin on the 8th day before an election and end on the 2nd
50 day before an election. Early voting shall be provided for 8
51 hours per weekday and 8 hours in the aggregate each weekend at
52 each site during the applicable periods. Early voting sites
53 shall open no sooner than 7 a.m. and close no later than 7 p.m.
54 on each applicable day.
55 (f)(e) Notwithstanding the requirements of s. 100.3605,
56 municipalities may provide early voting in municipal elections
57 that are not held in conjunction with county or state elections.
58 If a municipality provides early voting, it may designate as
59 many sites as necessary and shall conduct its activities in
60 accordance with the provisions of paragraphs (a)-(d) (a)-(c).
61 The supervisor is not required to conduct early voting if it is
62 provided pursuant to this subsection.
63 (g)(f) Notwithstanding the requirements of s. 189.405,
64 special districts may provide early voting in any district
65 election not held in conjunction with county or state elections.
66 If a special district provides early voting, it may designate as
67 many sites as necessary and shall conduct its activities in
68 accordance with the provisions of paragraphs (a)-(d) (a)-(c).
69 The supervisor is not required to conduct early voting if it is
70 provided pursuant to this subsection.
