       Senator Bogdanoff moved the following:
       
    1         Senate Amendment to Amendment (302038) (with title
    2  amendment)

    5         Delete lines 2632 - 2682
    6  and insert:
    7         Section 47. (1) As used in this section, the term:
    8         (a) “License” includes any certificate, permit, medallion,
    9  or other evidence that authorizes a person to operate a public
   10  vehicle for hire within the geographic boundaries of a
   11  governmental unit.
   12         (b) “Governmental unit” includes a county, municipality,
   13  special district, commission, or other unit of state or local
   14  government.
   15         (2) Any governmental unit that is authorized to regulate
   16  the operation of public vehicles for hire within its geographic
   17  boundaries may adopt ordinances, rules, regulations, orders, or
   18  other acts that create a private property right or interest in a
   19  license to operate a public vehicle for hire within the
   20  geographic boundaries of the governmental unit. If the
   21  governmental unit that is authorized to regulate the operation
   22  of for-hire vehicles charges or has charged a fee in order to
   23  obtain the license, apart from an annual license fee, it is
   24  presumed that the governmental unit has created a private
   25  property right.
   26         (3) Upon the creation of such private property right, the
   27  owner of a vehicle for hire operation may pledge, sell, assign,
   28  sublease, or otherwise transfer the license to another person.
   29  Each governmental unit may, by rule, ordinance, or regulation,
   30  specify the procedure by which such property right may be
   31  transferred.
