2 | A memorial to the Congress of the United States, urging |
3 | Congress to take additional action to clarify and specify |
4 | the Environmental Protection Agency's legal and regulatory |
5 | obligations with respect to greenhouse gases. |

7 | WHEREAS, the Environmental Protection Agency has released |
8 | an Advance Notice of Proposed Rulemaking that describes a |
9 | nationwide plan to regulate greenhouse gases under the Clean Air |
10 | Act, and |
11 | WHEREAS, the Environmental Protection Agency's plan to |
12 | regulate greenhouse gases is very expansive in scope, |
13 | envisioning a nationwide cap and trade program for greenhouse |
14 | gases, additional motor vehicle regulations, and economy-wide |
15 | restrictions impacting a wide range of industries, including |
16 | dairy and beef operations, office buildings, hospitals, schools, |
17 | large homes, and houses of worship, and even regulating the |
18 | greenhouse gas emissions from lawnmowers, and |
19 | WHEREAS, the United States Court of Appeals for the |
20 | District of Columbia Circuit has recently ruled that the |
21 | Environmental Protection Agency does not have authority to carry |
22 | out a cap and trade plan under the Clean Air Act, and |
23 | WHEREAS, the Environmental Protection Agency's plan |
24 | represents policymaking that is the prerogative of the |
25 | legislative branch, and |
26 | WHEREAS, even committed proponents of ambitious greenhouse |
27 | gas regulation have expressed doubts about the Advance Notice of |
28 | Proposed Rulemaking approach, and |
29 | WHEREAS, climate change is a global issue, not a local or |
30 | regional pollution issue, which the Clean Air Act was designed |
31 | to address, and |
32 | WHEREAS, the Environmental Protection Agency's plan would |
33 | impose a massive economic burden on America without appreciably |
34 | reducing worldwide concentrations of greenhouse gases, NOW, |
35 | THEREFORE, |

37 | Be It Resolved by the Legislature of the State of Florida: |

39 | That the Congress of the United States is urged to take |
40 | additional action to clarify and specify the Environmental |
41 | Protection Agency's legal and regulatory obligations with |
42 | respect to greenhouse gases. |
43 | BE IT FURTHER RESOLVED that copies of this memorial be |
44 | dispatched to the President of the United States, to the |
45 | President of the United States Senate, to the Speaker of the |
46 | United States House of Representatives, and to each member of |
47 | the Florida delegation to the United States Congress. |
