| 5 | future review and termination or re-creation of the trust |

| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |
|
| 10 | Section 1. Destination Resort Trust Fund.- |
| 11 | (1) The Destination Resort Trust Fund is created within |
| 12 | the Department of Revenue. |
| 13 | (2) The trust fund is established for the deposit of |
| 14 | licensing fees of destination resorts and the proceeds of gross |
| 15 | receipts taxes imposed on destination resorts. Funds may be |
| 16 | expended only pursuant to legislative appropriation or an |
| 17 | approved amendment to the Destination Resort Commission's |
| 18 | operating budget pursuant to chapter 216, Florida Statutes. |
| 19 | (3) In accordance with s. 19(f)(2), Article III of the |
| 20 | State Constitution, the Destination Resort Trust Fund shall, |
| 21 | unless terminated sooner, be terminated on July 1, 2015. Before |
| 22 | its scheduled termination, the trust fund shall be reviewed as |
| 23 | provided in s. 215.3206(1) and (2), Florida Statutes. |
| 24 | Section 2. This act shall take effect on the same date |
| 25 | that HB 1415 or similar legislation takes effect, if such |
| 26 | legislation is enacted in the same legislative session, or an |
| 27 | extension thereof, and becomes law, and only if this act is |
| 28 | enacted by a three-fifths vote of the membership of each house |
| 29 | of the Legislature. |
