1 A bill to be entitled
2 An act relating to the repeal of health insurance
3 provisions; amending s. 627.64872, F.S.; deleting a
4 requirement that the annual report of the Florida
5 Health Insurance Plan’s board of directors include
6 certain actuarial information relating to levels of
7 coverage and funding; amending s. 627.6699, F.S.;
8 deleting a requirement that the Office of Insurance
9 Regulation of the Department of Financial Services
10 annually report to the Governor and the Legislature
11 concerning the Small Employers Access Program;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Subsection (6) of section 627.64872, Florida
17 Statutes, is amended to read:
18 627.64872 Florida Health Insurance Plan.—
19 (6) ANNUAL REPORT.—The board shall annually submit to the
20 Governor, the President of the Senate, and the Speaker of the
21 House of Representatives a report that includes an independent
22 actuarial study to determine, without limitation, the following:
23 (a) The effect the creation of the plan has on the small
24 group and individual insurance market, specifically on the
25 premiums paid by insureds, including an estimate of the total
26 anticipated aggregate savings for all small employers in the
27 state.
28 (b) The actual number of individuals covered at the current
29 funding and benefit level, the projected number of individuals
30 that may seek coverage in the forthcoming fiscal year, and the
31 projected funding needed to cover anticipated increase or
32 decrease in plan participation.
33 (b)(c) A recommendation as to the best source of funding
34 for the anticipated deficits of the pool.
35 (c)(d) A summary of the activities of the plan in the
36 preceding calendar year, including the net written and earned
37 premiums, plan enrollment, the expense of administration, and
38 the paid and incurred losses.
39 (d)(e) A review of the operation of the plan as to whether
40 the plan has met the intent of this section.

42 The board may not implement the Florida Health Insurance Plan
43 until funds are appropriated for startup costs and any projected
44 deficits; however, the board may complete the actuarial study
45 authorized in this subsection.
46 Section 2. Paragraph (l) of subsection (15) of section
47 627.6699, Florida Statutes, is amended to read:
48 627.6699 Employee Health Care Access Act.—
49 (15) SMALL EMPLOYERS ACCESS PROGRAM.—
50 (l) Annual reporting.—The office shall make an annual
51 report to the Governor, the President of the Senate, and the
52 Speaker of the House of Representatives. The report shall
53 summarize the activities of the program in the preceding
54 calendar year, including the net written and earned premiums,
55 program enrollment, the expense of administration, and the paid
56 and incurred losses. The report shall be submitted no later than
57 March 15 following the close of the prior calendar year.
58 Section 3. This act shall take effect July 1, 2011.
