2 An act relating to veterinary practice; amending s.
3 474.202, F.S.; defining the term “limited service
4 veterinary vaccination clinic”; amending s. 474.215,
5 F.S.; revising terminology; requiring that the Board
6 of Veterinary Medicine establish minimum standards for
7 limited service veterinary vaccination clinics rather
8 than limited service veterinary medical practices;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Present subsections (7) through (13) of section
14 474.202, Florida Statutes, are renumbered as subsections (8)
15 through (14), respectively, and a new subsection (7) is added to
16 that section, to read:
17 474.202 Definitions.—As used in this chapter:
18 (7) “Limited service veterinary vaccination clinic” means a
19 veterinary practice at which a veterinarian performs
20 vaccinations or immunizations on multiple animals at a temporary
21 location.
22 Section 2. Subsection (7) of section 474.215, Florida
23 Statutes, is amended to read:
24 474.215 Premises permits.—
25 (7) The board by rule shall establish minimum standards for
26 the operation of limited service veterinary vaccination clinics
27 medical practices. Such rules shall not restrict limited service
28 veterinary medical practices and shall be consistent with the
29 type of limited veterinary vaccination medical service provided.
30 (a) Any person that offers or provides limited service
31 veterinary medical practice shall obtain a biennial permit from
32 the board the cost of which shall not exceed $250. The limited
33 service permittee shall register each location where a limited
34 service clinic is held and shall pay a fee set by rule not to
35 exceed $25 to register each such location.
36 (b) All permits issued under this subsection are subject to
37 the provisions of ss. 474.213 and 474.214.
38 (c) Notwithstanding any provision of this subsection to the
39 contrary, any temporary rabies vaccination effort operated by a
40 county health department in response to a public health threat,
41 as declared by the State Health Officer in consultation with the
42 State Veterinarian, is not subject to any preregistration, time
43 limitation, or fee requirements, but must adhere to all other
44 requirements for limited service veterinary medical practice as
45 prescribed by rule. The fee charged to the public for a rabies
46 vaccination administered during such temporary rabies
47 vaccination effort may not exceed the actual cost of
48 administering the rabies vaccine. Such rabies vaccination
49 efforts may not be used for any purpose other than to address
50 the public health consequences of the rabies outbreak. The board
51 shall be immediately notified in writing of any temporary rabies
52 vaccination effort operated under this paragraph.
53 Section 3. This act shall take effect July 1, 2011.
